Crossed Rifles on the cap is the US Army insignia for an Infantry Unit. The number 6 would be the 6th Regiment or Company. Now the Crossed Rifles were not used until the mid 1870s, replacing the Horn. So this is not a uniform cap that would have been worn in the Civil War. Where was he living in 1870 and 1880? That would help with identify the state he enlisted in.
But there were photography parlors even back then that had Uniform and other Costumes for a picture.

There were not that many African American army units at the time. Here is a website with the units:

I know he looks African-American but he's not. In all the other pictures he looks less black. He's actually 100% French Canadian. (Isn't that surprising? )
He was born 1846 and I think he looks quite young there. He was in Upstate NY from 5 until about 30.
I really am surprised that this would be after 1869. I also have his wedding photo in 1869 and he looks so much younger here.

They do bear striking similarities, quite possibly the same person. But as the other posters stated, the photos do appear to be later than 1869, both the army uniform and the style of wedding dress in the photo.
