Hello, I've been researching a man by the name of Henry Mitchell who was born in 1761, Sussex County Virginia and past away on May 17, 1839 in Sparta, Hancock County Georgia.

He was apparently at the battle (or massacre) at Waxhaws on May 29, 1780. According to accounts, he was the flag bearer who was saved by Captain David Kinloch of the British Legion. The problem is, most information on him that I can find lists him as being in the 11th Virginia Regiment. I've also found 1 account saying he joined the Continental Army when he was 18, which was in 1779.

Around 1778/79 the Virginia line was re-organized. Thus, the 11th Virginia was re-named as the 7th Virginia. The 7th Virginia was re-named the 5th Virginia, with the original 5th Virginia which was formed in 1775 being re-named the 3rd Virginia.

At Waxhaws in 1780, Col. Abraham Buford is stated as being in command of the "3rd Virginia Detachment" which according to most accounts contained 1 infantry company from the 7th Virginia Regiment and 2 infantry companies from the 2nd Virginia Regiment(with several other small units) So was his company from the 7th Virginia that was re-named as the 5th? Or were they from the 11th that was re-named as the 7th? I can find no military records of him other than what is mentioned of him from Waxhaws and what was written of him after his death. Can anyone make sense of this?

You can get records/documents on how he was proven thru DAR
Have you tried fold3 or any other sources to prove his military service

I have tried fold3, but nothing I found seemed conclusive at the time. As I recall I came across some documents concerning a Henry Mitchell, but no unit was listed I believe.

I have never done anything through the DAR, I don't think I've ever even thought of them before, but I'll certainly try to contact them now, thanks for the tip!

There is a pension request on both ancestry and heritage quest for a Henry Mitchell of Virginia

I looked and the ancestry has more pages and mentions a William Mitchell
you might have to do a timeline and find out if he lived with anyone of his children at time of death

But do contact a DAR chapter or contact DAR they will assign a chapter close to
