Re: Findagrave isn't a nice place
I would have to say that personally, I do consider it a genealogy research site. It's awesome that I can find where ancestors were buried on line. However, the burial, photo of the markers etc. are just a small part of a person's life. I not really into gravestones, even though I have photographed a cemetery myself, I have not yet been in a big hurry to update Find A Grave because well, they are going anywhere.
I did totally make a goof on there and duplicated a record. No one jumped on me about it. I felt like a dummy. However, I have found mistakes myself where someone has added all of the cemetery information, and then when I add the photo, I find they have transcribed the marker incorrectly. I in no way care how many I do or if someone takes them over later especially if they can fix mistakes. It's not like everything on this site is correct either.
I'm not surprised that some of the admins are self appointed Findagrave police.

Re: Findagrave isn't a nice place
And findagrave has now been bought by Ancestry which suggests it is a genealogy resource

Re: Findagrave isn't a nice place
I didn't mind taking requested pics gladly shared figured that what it was for to connect family that weren't close to be able to do it themselves. I didn't care to get credit acknowledgement... If I requested a photo I didn't hesitate to say Thank you cuz no way I would be able to travel out of state. But what I found from using Find a Grave that when I posted my pics of my own family they were taken and someone else took credit that when I was pissed why would a stranger what to take credit ??? Its a shame if you ask me. When finding ancestors yes census help etc... but having the stone helps if you can't find anything else. which was the case for couple of my ancestors. No death records to be found so by finding the stones has help. If this site not for helping with genealogy then guess I cancel my too

Re: Findagrave isn't a nice place
I only had one interaction with someone on Find a Grave a large contributor who scolded me for the way I contacted him. He did however provide a photo once I followed his guidelines for requesting. I have many photos I have taken of cemeteries in my area in NE with Rev. War to late 1880s I had started to add a few to cemeteries where someone else had entered a number of stones but now that I know Ancestry owns this site I won't put anything there anymore because I am sure it will all disappear under their umbrella needing to be paid for to view. I have long wanted to just put them on a website I created but not really tech savvy about that so have never done it. I continue taking pictures and maybe some day I will find someone to help me otherwise I rarely go to FindaGrave.

Re: Findagrave isn't a nice place
The press release can say whatever it wants - it's not a contract so they can change their mind any time they want.
Consider what Ancestry did with last year's acquisition, 1000memories.com. Purchased during October 2012 and shut down August 2013.

Re: Findagrave isn't a nice place
So you have seen the contract that was signed when Ancestry purchased Findagrave?
1000memories was closed yes but the pictures that were on the site could be transfered into the owners tree. This is a completely different situation than findagrave. They have publicly said that this would remain under free availabilty. They actually cant do anything but close Findagrave because they dont own the photographs or the copyright on the pics or the transcriptions that appear. So if they take the site down and then use the pictures etc on a paid site they could be sued.
If you dont like what Ancestry are doing dont subscribe but why are you using their message boards as well? You cant have it both ways

That is incorrect. On 17 June 2013, Find A Grave implemented a Terms Of Use documented that included: "By submitting User Provided Content to Find A Grave, you grant Find A Grave a transferable license to use, host, sublicense and distribute your submission to the extent and in the form or context we deem appropriate on or through any media or medium and with any technology or devices now known or hereafter developed or discovered. Except for the rights granted in this Agreement, Find A Grave acquires no title or ownership rights in or to any content you submit and nothing in this Agreement conveys any ownership rights in the content you submit to us."
That license was transferred to Ancestry with the purchase of Find A Grave. Ergo, Ancestry *can* redistribute all submissions in whatever extent, form or context they (Ancestry) deem appropriate. In other words: they can do whatever they want with them.

Re: Findagrave isn't a nice place
Yes that agreement allows them to use the photography at their discretion however it does NOT supreced copyright and Ancestry cannot make money from any copyrighted work without the permission of the said copyright holder. If they did you would have a claim through the courts in the US for breach of copyright. US payouts for this are usually quite high. Ancestry a few years ago lost a case through the UK courts in a very similar set of circumstances which cost them a large undisclosed compensation payment and then a large number of years of royalty payments.
I also believe that as copyright holder and the fact that copyright supercedes that term in their agreement that ancestry/findagrave using your pictures outside of their site would also constitute a breach of copyright and trust. I know of cases where these sorts of agreements are within the terms yet the courts have stated that the fact this exists does not take away from the fact the uploader thought the pictures were just to be shared through the particular site and for the company to use them elsewhere was an actionable breach of trust

Re: Findagrave isn't a nice place
So you don't even believe a person like myself with over 2000 photographs from area cemeteries should put them online free. Surely you don't mean that.
