Refused a Death Certificate

My Great Grandfather died in 1942. I have paid twice to get his death certificate from NY and finally Saturday got a form letter stating they were denying my request because enough time had not passed.
WHAT? I mean he is a relative. And they did not ever question that at all just saying enough time has not passed. Oh and no they did not refund the fee they charged me twice. The first time was about 2 years ago and I just never heard back from them and this time heard back within 8 weeks.
Can they refuse a death certificate? well I guess they can because they did. But what is with the time. I got my grandmothers who died in 1937 from NY without a blink of an eye so why is the same state now saying I cant have one? If I find out this is because I have recently gotten one and its something to do with the securities act I am going to go postal on those folks. There are more illegals here than we can shake a stick out dont make the citizens keep suffering for it.
