I am well aware of the absence of mention of a Hannah ASHMORE. I do NOT beleive that ANY Walter ASHMORE in NC or SC had a daughter named Hannah. I believe that there was ONE Walter ASHMORE who died in York, SC, leaving a widow named "Cleranah ASHMORE" who was also known by the name "Hannah."
There seems to be NO DOCUMENT that would seem to suggest that a Hannah ASHMORE was a daughter to ANY ASHMORE.
The indication that the Will purportedly giving Hannah the entire estate was witnessed by "Richard, Benjamin and James FINCHER" would seem to me to be highly suggestive that these are Hannah ASHMORE's BROTHERS.
A Will making specific bequests of livestock to minor children would appear to me to be EXCEPTIONALLY UNSOUND. The FINCHER brothers probably had the good sense to see that this was very ill advised and probably talked Walter ASHMORE out of his 1790 legacies while Walter was on his death bed. However, this might have been viewed as "undue influence" by the FINCHER brothers favoring their SISTER at the expense of the children. Even if this was a valid LATER WILL freely entered into by Walter FINCHER, if the will favoring the children was admitted into probate in York County and a final order entered in that court, Hannah would have forfeited her right to probate the later Will if she failed to timely bring that Will forward.
One key question presented by the Oct 1798 Order is WHO is Archibald HENDERSON? Was he merely an attorney acting on behalf of one of the children? Or was he the spouse of one of Walter ASHMORE's daughters: Margaret, Mary, and Ellinor.
