In the name d God, Amen. This fourteenth day of September in the year of our Lord one thousand eight hundred and seven, I David Peffley, Senior of Bethel Township in the County of Dauphin, and state of Pennsylvania, being sick and weak in body, but nevertheless of sound mind and memory,and understanding thanks be to God for the same.

Calling unto mind the mortality of my body considering the uncertainty this transitory life, knowing that it is appointed for all men once to die, do make and publish this my Last Will and Testament in a manner and form to wit; Principally and first of all, I recommend my my immortal soul into the hands of God who gave it, and my body to the earth to be buried in decent and Christian like manner at the discretion of Executors hereinafter named. And as touching concerning such worldly estate wherewith it has pleased God to bless me in this life, I give, devise, dispose of the same in the following manner and form. Imprinis This is my will and I do hereby order in the first place that all my just debts and funeral expenses be duly paid and satisfied out of my estate as soon as conveniently may be by my hereinafter named Executors. Item I give and bequeath unto my dearly beloved Maria Peffley two beds as she shall such as she may chuse, one cow one sheep at their choise all her clothings one chest the house clock together with such of my household furniture and Kitchen utensils as she may choose to keep for her own use she may take before appraisemnet is made of my personal estate and it is further my will that my said wife Maria (Sherrick) Peffeley should have one hundred and fifty pounds lawful money after my decease out of my personal estate or moveables as soon as the goods are sold and the money collected for same which said money shall be for her own use to do with at pleasure and shall be in lieu all her third out of all my real and personal estate(Except those artickles hereinafter mentioned in a Dower of the plantation I now at present live on to be delivered to her by my sons during her widowhood) and her saddle and bridle to be delivered to her before appraising.

Item This is my will and and I do hereby order that my two sons Abraham Peffley and Casper Peffley their heirs and assigns shall have my plantation where I at present live on situate lying and being in Bethel Township, Dauphin County aforesaid adjoining land of Henry Spittler, John Shuy, and Lentzes and others containing one hundred sixty-nine acres and allowance to be the same more or less. Together with all and singular the buildings thereon erected and being built and also all the grain in the ground with all deeds and other writing as touching or concerning the same. To have and to hold the said plantation and premises with the appurtances unto them the said Abraham Peffley and Casper Peffley ( as tenants in Joint and not in separate) their heirs and assigns to only the proper use benefit and behoof of them the said Abraham Peffley and Casper Peffley their heirs and assigns forever under and subject to the payment (and dower) hereinafter mentioned that is to say that my sons Abraham Peffley and Casper Peffley shall well and truely pay or cause to be paid for my said unto them bequeathed land or plantation unto my hereinafter named children or to their representatives heirs executors administrators or assigns the full sum of two thousand pounds lawful gold or silver money of the State of Pennsylvania on condition and first payment and yearly terms and payments as follows that is to say eight hundred pounds shall be the first payment and shall be paid three months after my decease out of which eight hundred pounds my said sons Abraham Peffley and Casper Peffley shall have each of them two hundrd pounds for their portion and share to be equal wiyh my other sons, John and Jacob Peffley, so there is but four hundred pounds pounds to be piad by them in such manner one hundred pounds unto my daughter Catharina the wife of Henry Daub, or to her heirs and assigns and the other one hundred pounds unto Maria now the wife of John Zercher, and the remaining fourteen hundred pounds shall be distributed into equal payments to each one hundred pounds the first payment unto my daughter Magdalena Peffley payable the first day of May next after my decease which payment shall be taken of the remaining two hundred pounds left from the first or payment and then one hundred pounds as the remainder of the said two hundred pounds to be paid to my son Christian Peffley and then the first payment of one hundred pounds to unto Barbara Peffley on the first day of May following after the first day of May after my decease and one hundred pounds unto my daughter Elizabeth Peffley on the first day of May in the third yearter my decease and then to begin again with my daughter Catharina until my daughter Elizabeth as the youngest each around one hundred pounds beginning the fourth year always the first day of May in every yearand when round it will appear they are equal in share of two hundred pounds apiece (excepting my son David which shall draw his share out of my other plantation) and for the remainder of the two thousand pounds all my eleven children shall have share and share alike (and it is further my will that my sons Abraham and Casper shall hold and keep for my two youngest daughters two cows for each of them in feed and pasture in their use till they marry and shall keep that colt for my son Christian which is the youngest on the place which he shall have out of my estate heretofor bequeathed to keep it in feed and pasture till it is two years old without any charge for the cows or colt but the said sons shall not sell the land as long as their mother lives as only to their friends or brothers and sisters.)

Item It is my will and I hereby order that my said wife Maria shall live and possese the dwelling house which I now live in for her dwelling during her natural life with my sons or son in any part of the house as she will chuse without any disturbance or molestation but if she would rather chuse to live separate then the said Abraham and casper Peffley are to build her a house to any such place as she shall chuse and furnish the same compleatly so as she shall order and shall have one of my pipe stoves with the pipe and my said sons shallgive unto my beloved wife their mother yearly and every year during her natural life eighteen bushels of grain in such manner namely viz. Eleven bushels and a half of good merchantable wheat, six bushels and a half of good clean merchantable rye and take grain to mill and bring the flour and bran to her dwelling at such time and to such place as she from time to time shall order six bushels of cleaned Inshing corn and the same to be delivered to her immediately after my decease of the grain resent in the barn and potato at anytime as much as she shall want for her use and further they shall give her a fat hogg weighing atleast two hundred weight with all the lard and reins and fifty weight of good fatted beef twenty pounds of clean hackled flex and tow so much as she will chuse three bushels of apples for winter if any and two bushels dryed apples one barrel of clear cider and a half barrel mixed for vinegar one pair of shoes and mented as much as needful and firewood small cut and hawled to her dwelling house ready fit for pipestove herth and oven as much as she shall want both summer and winter and shall have a right to enter into the kitchen garden and dig and plant so any kind of herbs as she shall chuse for her own use in any part of it and shall feed her cow and one sheep with and like their own and pasture in the summer like their own in such place with their own and at anytime to give her a horse when she requires one to ride out and she shall have a right at any time to kill a fowl or chicken or to take so many eggs on the premises as she shall want for her own use and it is further my will that my said wife Maria shall have the right and priveledge to go or enter in any part of the plantation or premises without doing damage to anything at least and free liberty to go from and to her dwelling and also for any of her children a right to go from and to her dwelling and also for any of her children a right to go to the stove the right to go to the kitchen and the fire hearth to cook a right to the well to the celler springhouse and upstairs a right to go to the barn& stables a right to go in the orchard or to any other ( It is further my will that those grains I bequeath to my wife be delivered to her immediately after my decease before the grain shall be sold) fruit trees to take as much as she should eat of everykind of apple plums pegious cherries &c a right to the oven to bake her bread and it is further my will that they the said Abraham and Casper Peffley shall maintain and give every support and relief to their mother in sickness or at any other time when circumstances may require it in case of sickness or unableness they are to wash all of her clothing and bedding and milch her cows and I do further hereby order that if my wife should chuse to have another cow at any other time thay are to give her another in the place so as she chuse and to take hers in the place of theirs and they are to give every year one peck fine and three pecks coarse salt.

All these and foregoing artickles of dower (besides other bequests before mentioned) to my wife Maria bequeathed shall be truely performed in every point by my sons Abraham and Casper Peffley, their heirs Executors and administrators as long as she will be and remain my widow and no longer and further that all these before mentioned artickles and bequeathed money and effects out of my plantation and personal estate shall be in lieu all of her third at common law.

Item. It is my will and I hereby order that my son Daniel Peffley his heirs and assigns shall have my plantation which I have lately bought situate in West Hanover township, Dauphin County aforesaid adjoining lands of Jacob Zerring, John Snodgrass, Backenstoz and others containing one hundred and six acres togetjer with all and singular the buildings thereon erected and being built and also with all deeds and other writings as touching or concerning the same. To have and to hold the said land Plantation and premises with the appurtenances unto him the said David Peffley his heirs and assigns to the only proper use and benefit and behoof of him the said David Peffley his heirs and assigns forever under and subject to the payment hereinafter mentioned that is to say that my son David Peffley shall well and truely pay or cause to be paid for this unto him bequeathed land and plantation the sum of nine hundred and seventy five pounds in gold or silver money of the state of Pennsylvania on the following conditions that is to say it must all be in cash money except three hundred and thirty seven pounds ten shillings I have laid out of my own money and paid on said premises of which he shall draw back two hundred pounds for his equal share onst with his brothers and sisters and the remaining one hundred thirty seven pounds ten shillings shall be considered as part of my estate the rest of the money for which are bonds given by me he must pay all of such bonds to whom they are given and all the grain in the barn I bequeath to my son David Peffley for this present year or after that is to say for one year and no more.

And as touching all the rest residue and remainder of my estate and moveables of what kind and nature soever the same may be in the County of Dauphin or elsewhere (except what is hereinbefore bequeathed) which I shall leave behind me at the time of my decease to be sold at public vendue and to be equally divided unto my children share and share alike that is to say to my sons John, David, Casper and Abraham and Christopher Peffley and daughters Magdalena, the wife of Henry daub, Catharina, the wife of John Zercher, Maria, Barbara and Elizabeth Peffley and to there heirs and representatives but in case any of my hereinbefore children should dies without lawful issue then their inheritance shall be divided to and among the rest of my remaining children share and share alike. Item. It is my will and I do hereby empower my trusty friend Abraham Sherrick to sign seal and execute a good and sufficient deed or deeds for my said lands unto my herein named sons and to their heirs and assigns forever likewise all the remainder of my estate and moveables which I leave behind me at my decease( except as before excepted) I give and bequeath unto my above named children and to their heirs and assigns forever.

And lastly I hereby nominate constitute and appoint my son John Peffley and my trusty friend Abraham Sherrick Executors of this last will hereby revoking and disanulling and making void all former and other wills and will and Executors by me hereintofor made ratifying and confirming this and no other to be my last will and testament in witness whereof I the said david Peffley Senior have hereunto set my hand and seal the day of the year aforesaid.

D. 1807 before me the subscriber Register for the Probate of wills&c in and for the said county personally came Abraham Lentz and John Stoudt being the subscribing witnesses to the within will and being duly sworn as the law directs doth depose and say that they were present and saw and heard David Peffley the testator sign seal publish pronounce and declare the foregoing instrument of writing as and for his last will and testament and at the time of so doing he was of sound and disposing mind memories and understanding to the best of their knowledge and belief.
