I am seeking information about a Nancy Pemberton of Washington County , Virginia that was the wife of a Colonel Humbertstone or Humberton Lyon (Abt. 1724 in MD, and died 1784 in Washington Co, VA) that died at the "Battle of Kings Mountain" during the "Revolutionary War" . The only information I have on Nancy Pemberton Lyon is that she is the daughter of a John Pemberton and she may be a close relative of a George Pemberton of Washington County , Virginia (Abt 1760- died 1835) husband of a Mary Lyon son of Richard Pemberton of Manakin , Virginia since George Pemberton was awarded "legal guardianship" of Humberstone Lyon and Nancy Pemberton's children . Also does anyone know what Mary Lyon's relationship to the Hunbertstone Lyon family might be ?

Hi - Came across this old msg of yours while searching for info on Humberstone Lyon's (1690-1743) wife. Your question pre-supposes that Humberson Lyon (1724-1784) was married to a Nancy Pemberton. That's possible but I've not found any evidence of it. My information is that Humberson (1724-1784) was married to a woman named Mary. After the death of Humberson, Mary wed George Pemberton on 5 Nov 1785. Thereafter, George Pemberton was appointed guardian of three of the Lyon children. In the early 1800's, all three children filed suit against Pemberton and two other men alleging they failed to carry out Humberson's will. The suit went on for several years, even after George Pemberton passed away. Two of Pemberton's sons became litigants after he died in Kentucky. You can read the suit at http://www.lva.virginia.gov/chancery/case_detail.asp?CFN=015.... The suit fails to further identify Mary or indicate when she was married to Humberson Lyon. Their first-born was Humberson Lyon (1760-1780), so in my tree I have Humberson and Mary wedding about 1759.

It's possible that Humberson was married to a Nancy Pemberton before he wed Mary as he would have been about 36 years old when he married Mary (if they wed around 1759/1760). I've seen other family trees that have Humberstone (1690-1743) married to Nancy Pemberton but they are unsourced.

Any light you can shed on Humberstone Lyon's wife would be most appreciated. I'm happy to share any information with you. My tree (Lyon(s)/Prather Family Tree) is public.

By the way, the Humberson Lyon who was killed at the Battle of Kings Mountain was Humberson Lyon (1760-1780). The Humberson Lyon who died in 1784 was his father. The battle was fought on 7 Oct 1780, so it couldn't have been the one who died in 1784; had to be the one that died in 1780.

I have seen several websites that have said that Nancy Pemberton daughter of a John Pemberton and Jane Coleman was the wife of Humbertson (Humbertstone?) Lyon and the mother of his children . Lisa Pemberton from "Pemberton Family World-Wide" ( www.pfww.org ) has told me about finding a courthouse record that shows George Pemberton's wife Mary was the second wife and widow of Humbertson Lyon and about George receiving guardianship of the Lyon children , but unfortunately she couldn't find out what Mary's maiden name was either . I might also add that Marty Grant from " www.martygrant.com " has also told me there is a record of a George Pemberton inheriting land from a Hyram Lyon in Washington Co. VA .

Because the old handwritten court record is difficult to read can you tell me if it confirms that the George Pemberton that had lived in Washington County VA before 1800 is in fact the same George Pemberton that later lived in Wayne County KY and can you give me the name of the two sons that became litigants in the case ?

By the way I have to thank you for clearing up the confusion about the two Humbertson Lyons .

Yes, I've seen those same websites re: Nancy Pemberton being Humberson Lyon's wife but I've seen no sources for that information. I don't have any information about Mary being the second wife of Humberson Lyon either.

Yes, the court documents are difficult to read. In order for me to read them, I had to print each page and read it with a magnifying glass. As best as I can read and understand them, when the suit was first filed (before 1800), George Pemberton resided in Virginia. In one of the pleadings, filed in 1803, Pemberton lived in Lincoln County, KY. In another, filed in 1804, he lived in Adair County, KY. If memory serves me right (I couldn't find it this time), in another pleading, he lived in Russell County, KY. I didn't see any reference to Wayne County. The two sons were Thomas and Lewis.

Yes it has helped . It has long been believed that a George Pemberton that moved to Wayne County KY after 1800 was the same George Pemberton that had earlier married a Mary Lyon in Washington County VA , however DNA test have shown that a William Pemberton of Adams County OH that was believed to be George's brother isn't related , a Richard Pemberton that moved to Wayne County KY with George Pemberton doesn't have the children he was supposed to have , and I've been recently told that the George Pemberton that lived in Washington County VA was too old to be the same George Pemberton that later lived in Wayne County KY .
Now you have found a document ( http://www.lva.virginia.gov/chancery/case_detail.asp?CFN=015... ) that proves once and for all that the George Pemberton that married Mary Lyon in Washington County VA before 1800 cannot be the same George Pemberton that moved to Wayne County KY after 1800 .

Unfortunately I now have no idea as to who my ancestor George Pemberton of Wayne County , Kentucky really is .

Thought you should know that the George Pemberton that lived in Adair County KY is listed as being married to a Sarah Cason not a Mary Lyon , however he did have two sons named Thomas and Lewis Pemberton that were named administrators to his estate after he died . Could this George Pemberton have been married more then once ?

I have very little information on George Pemberton as he is not, as far as I know, related to me. He may very well have been married more than once. According to the lawsuit filed by the Lyon children against Pemberton, he was definitely married to Humberson Lyon's widow. I found it curious (and frustrating) that the lawsuit failed to reveal anything about Mary Lyon. She did not appear to be one of the litigants. She wasn't deposed. The suit contained no indication as to where she stood in the court battle between her children and her erstwhile husband. For all I know, she may have died during the pendency of the suit. I haven't been able to locate any information about her, e.g., DPOB, DOD, maiden name, etc.

I have seen sites that have a Sara Cason marrying a George Pemberton that was born in 1744. One of the lines from them matches my wife's lineage per her mother's research.
That lineage is George Pemberton & Sara Cason, then William Pemberton & Nancy Skaggs, next Thomas Pemberton & Dicey Winfrey, leading to Alexander Pemberton & Mary Vardim Jeffers, (my wife's GGF) George Washington Pemberton & Mary Elizabeth Devore, (her GF)Clarence Edward Pemberton & Nancy Richards. My mother-in-law research differs in that she has the first George marrying a Mary Lyon instead of Sara Cason, but when I find that George on other sites, the dates of his birth, 1760 & marriage to Mary Lyon seems to contradict the possiblity that he is the right George because William was born in 1780 before the marriage of that George to Mary Lyon. I think she has tied to the wrong George. I would like to confirm the lineage to Sara Cason for my wife and her mother. I also notice that the George that married Sara Cason was born in Lancastershire, England; does anyone know what ship he came to the colonies on and when?

Evidently it's the George Pemberton of Adair County KY that was really married to Mary Lyon not my George Pemberton of Wayne County KY .

I might add the Adair County KY George Pemberton had a son named George that was born in 1784 which would put him in the correct age range for the George Pemberton in Wayne County KY according to the 1810 census . I wonder if we might be dealing with a father and son ?

What is the date of the lawsuit? What are the names of the Lyon children? Are they adults or literally children? George and Mary are both common names. The could be one George who married two Lyon women names Mary. Or there could be two different couples. By the way, where was the lawsuit filed? Time and place could be very important in sorting this out. What is the purpose of the lawsuit?

The Chancery Records Index Number is 1809-153, suggesting that the suit was filed in 1809 but it contains documents dated as early as 1804. The Lyon children were adults: James Lyon (1770-1820), Stephen Lyon (1777-1845), Jacob Lyon (1779-1867) and Susannah Lyon Miller (1781-1817) and her husband Joseph Miller. The suit was filed in Washington County, Virginia. After Humberson Lyon died in 1784, his widow Mary (maiden name unknown) married George Pemberton on 05 Nov 1785. Thereafter, George Pemberton was appointed guardian of five of the Lyon children (I think I previously said three). Subsequently, these same children, then adults, filed suit against George Pemberton for allegedly keeping property that Humberson willed to the children. The suit also alleged that the administrators of the will (I believe Abraham Crabtree and a couple of others) failed to carry out the provisions of the will.

The almost 50 handwritten documents contained in the Chancery case are very dark and difficult to read. Most of it is written in early 19th century "legalese" which adds to the difficulty Also, the file may not be complete because I was unable to find a final judgement in it. It did not contain identifying data regarding the litigants or others mentioned in it, i.e., did not identify George Pemberton or any other person by date of birth, etc. But, there was sufficient information in it to discern that a man named Humberson Lyon who died in Washington County, Virginia in 1784 left a widow named Mary who subsequently married a George Pemberton who became a guardian to Humberson (in the suit he was referred to as Humberton) and Mary's children who were named James, William, Stephen, Jacob and Susannah. My Humberson Lyon was married to a woman named Mary and had six children: Humberson (1760-1780), who was killed at the Battle of Kings Mountain, James, William, Stephen, Jacob and Susannah, who married a man named Joseph Miller.

Now, I am aware that there are more than one George Pemberton and I cannot say which George Pemberton Mary married -- I know little about the Pembertons as they are not in my line. In any event, it was a George Pemberton who once lived in Washington County, Virginia, relocated to Kentucky some time in the early 1800's, had two sons named Thomas and Lewis, and apparently died between 1804 and 1809. The only indication I have that he died during that time is that the lawsuit, at some point, refers to him as "deceased." I assume that is the reason why Thomas and Lewis replaced George as defendants.

I am also aware that many family trees have a George Pemberton who married a Mary Lyon from Washington County, Virginia as dying in 1835 in Wayne County, Kentucky. I have no explanation for that other than there may be two Mary Lyons or they have attached Mary Lyons of Washington County, Virginia to the wrong George Pemberton.

As I said before, the lawsuit makes for difficult reading but a closer reading of it might tell you a little more about this George Pemberton. For example, which counties in Kentucky he may have lived in and when, when he died, etc. As you know a lot more about the Pembertons than I do, you may be better able to discern relevant facts from the document than me.
