If your ancestor was J. D. Irwin this link will be of interest to you. Dr. Irwin was involved in a 1905 shooting of Alpha Mann at Kaw City, Oklahoma. As he was defending a man he knew, J. L. Bussert, many thought the shooting was justified. However, he was tried and convicted in Kay County court. He was sentenced to ten years at the federal prison in Lansing Kansas, where in April 1908, he was paroled by OK Governor Haskell. In August that year, the governor pardoned Irwin of the crime.

Sorry, none of the articles gave a first or middle name. In one if the stories Mr. Irwin was described as about 45 years-old, and married with a child. He had lived in Kaw City for five years. Called by the title, Doctor, in all the articles; He was, also, referred to as a pharmacist. Some articles give his initials as J. B. or J. H.

The reason he was sent to prison at the federal pen in Kansas was before Oklahoma became a state, crimes committed in the Oklahoma Territory were federal crimes, A state prison system was not established until after statehood in 1907.

If this fits your ancestor, your questions are finally answered, you could not no court records because when a person is pardoned by the governor all legal records are erased, Officially it is though the crime never happened. Newspaper accounts are the only record you will find.
