Hi Sherri. I don't know of absolute proof, but there has been talk of a record that a James Irby bought the family Bible. I do have copies of all the records that I have been able to find on Henry, but I can't remember finding that one. I do have a copy of the sale of his personal items after the death of his wife, Mary Polly. I'll look to see if he is listed there.

The debate with James being a son is this: Why would he have to buy the Bible if he were his son? (And, maybe back in 1803 all personal items were supposed to be "sold"). James is certainly closely related somehow, and I do think that he is Henry's son. I also had a dna match with his descendant, but it was autosomal so it's hard to tell for sure where the match comes from.

I descend through Henry's son John who would be a brother to your James. John is mentioned once in the probate papers, but there were four legatees, so there should be four children somewhere. I think William Henderson and Carter Irby handled the probate. James Henderson was a guardian of John Irby, I think (while he still lived in SC). It has been a few years since I've read over this information, so do not quote me on this. I did want to respond now to help me remember to look. It will take me 2-3 weeks to get to that information. I can also tell you that when John Irby received his legacy, it did go through the courts. If you know where your James was living when he turned 21, you could check the court records there. I would also check in Newberry County, SC.
