The following is a transcription from page 65 of the Grainger County Circuit Court Minutes Book, covering the years 1846-1851, held by the Grainger County Archives, in Rutledge, Tennessee:
Wednesday, August the 25th, 1847
& Jane Holt} Lewdness
The death of Jane Holt one of the Defendants in this case is suggested to the Court and not denied, and thereupon by order of the Court, this Cause abates as to said Jane Holt; and this cause is continued, on the affidavit of Thomas Whiteside the other Defendant as to himself until the next term of this Court. And thereupon came John Netherland into Court and acknowledged himself to owe and be indebted to the State of Tennessee in the sum of five hundred dollars of his proper goods and chattels, lands and tenements to be levied to the use of the State, but to be void on Condition that the said Defendant Thomas Whiteside make his personal appearance at the next term of this Court to be held for the County of Grainger at the Court house in Rutledge on the fourth Monday of December next, then and there to answer to a charge of the state exhibited against by Indictment for Lewdness, and not depart the Court without leave.
