John Roberts, miner, Geelong and Ballarat

Surnames: Roberts and Hayes
John Roberts was my 2nd great grandfather, he married Catherine Hayes in 1851 at St Peter's Church, Eastern Hill, Melbourne. They first lived in Geelong and eventually moved to Ballarat by 1860. They had 10 children. Does anyone know if this John Roberts is the same John Roberts who came on the ship Maitland as an exile in 1846, landing in Port Phillip Bay? He is not buried with Catherine, and the death certificate I do have is for a man never married with no relatives buried in Old Ballarat Cemetery. The dates of arrival etc tie in, more or less. Hope someone can help.

I have conflicting information on John Roberts. Early research done by a genealogist in the 70s and 80s by a family member had John from Kingston in Surrey, but the same research also listed him as coming on the Maitland circa 1846. John the exile was tried and sentenced in Lancashire in 1844 and spent two years in Pentonville before being transported. On his marriage certificate from 1851 there is no occupation or where he is from.

Just to clarify - you say "the death certificate I do have is for a man never married with no relatives buried in Old Ballarat Cemetery".

So are you saying you think this is the wrong death cert for 'your' John, who obviously did marry and have children?

Or does that death seem likely to be the John who arrived aboard Maitland? What year is that death? And when and where did Catherine die?

Yes, that is correct on the death certificate, he died in 1894. Catherine entered the Ballarat Asylum later in that year and died in 1897, she was buried with a daughter who died young. Details on death certificates are quite often inaccurate, with information supplied by people who did not have all the facts. Eg, Catherine and John had a large family, but her death certificate does not mention children or marriage at all.

Marriage records in 1851 were parish records and did not have fathers' names.

Information on death certificates for those who died in public institutions is usually scant.

All deaths in public institutions were subject to an inquest. Wonder if there is any info in her file at Pubic Record Office of Victoria.
