THE LAST WILL & TESTAMENT OF THOMAS (1) CHAPPELL
1658 Mar: Thomas (1) CHAPPELL, after only 23 years in his new home, dies in Charles City Co.
1658 Apr 4; His Will of Record follows:
"Edd Firzgarald exa'ed and swore that shortly before the death of Thos: CHAPPELL the dep't (deputy) was at his house, and the said CHAPPELL sent for Mr fferd Aston and before him and the dep't Declared, as his last will, that he gave and bequeathed to each of his children two breeding cattell, and his lands to his eldest son and his heires for ever and the rest of his estate to his wife, and in case of misuse of the children the said mr Aston was to be overseer of them and their estates and further sayth not.

"Ferdinando Aston ex'aed sworne saith and deposeth the very same in each particular, and further saith not, onely that the sd CHAPPELL the day before his death sent again for the dep't and desired his care of the sd children and their estates. Ferd Aston Jur in Cur Apr 4, 1658 Teste Hoel Pryse Cl Rec Apr 27, sequ."

It will be noted that at his death, Thomas had other children and it would suggest one or more other sons (Thomas the eldest). Thomas (2) was to receive all his fathers land.
Young Thomas (2) had evidently been apprenticed to Jo Richards, but was released the same year as his father's death. He was 18-20 at the time, as evidenced by the guardianship of Ferd Aston. His widow was to remarry, as shown by the following entries.
1658 Oct 4, Possible date of the death of Thomas (1) CHAPPELL
1658 Thomas (2)* Chappell: Release from Apprenticeship.
"It is ordered that Corne and Cleathing according to custom be forthwith paid to Thos CHAPPELL (who was) late servant to Jo Richards Dec'D out of the s'd Deced't's estate by the exe'r or Adm'er thereof also w'th Costs"

1658/59 abt: Thomas' (1) widow remarried to Walter Darnham. Since there were minors involved, the court reminded Darnham of his responsibility to his step children.
"Ordered that Walter Darnham who married the relict of Thos: CHAPPELL, dec'd, satisfy and pay unto the deced'ts orphans their severall dues and porcons according to law and the nuncupative will of the Deced't testified by mr Edd Ffitzgarald and mr fferd: Aston and that he maintain and educate them till their full age, and give good caution for performance thereof."

Though Thomas was probably of age, 21yrs, at the time, there were other children who were not. Therefore, this ruling was necessary. The Va. society saw fit to grant extra court protection for orphans of the time. The following Charles City Court order is found on record.
Charles City Court records show: "Ordered that all possessors of orphanes estates shall give such security for the same as the Co'rt shall think suffic't, or else that such estates be sold at an Outcry and deposited into such sure hands as the Co'rt shall appoint."
