Surnames: Mitchell, Banks, Cummings
Tennessee Divorce Records at Ancestry contains documents relating to the divorce of Emeline Banks and Wilson or Wilse Mitchell (apparently the same as the Daniel Wiley you mentioned). Interestingly, the divorce complaint was filed in 1868. Mr. Mitchell has been confined to the penitentiary and his mother Lucy is accused of conspiring with him to deprive Emeline of children and property. Actual trial hearings seem to have been scheduled for Nov 1868. The handwritten documents are somewhat difficult to read. One page seems to have the court finding in favor of Emeline and awarding the divorce. Another page seems to indicate that Emeline has withdrawn her complaint with Wilson to pay court costs. The pages are undated, so it is unclear whether or not the divorce was actually granted. Yet another page has dates which may indicate that the case dragged on into 1870 or beyond.

Ancestry has the item indexed under "W H Mitchell" and "Emelene Mitchell". Someone misread "W&L" (for Wilson and Lucy) as "W H".

D W Mitchell is enumerated as a Convict in the Penitentiary in 1870. He may or may not be the same as Daniel Mitchell found in 1880 Lauderdale AL with wife Malinda Cummings Mitchell.

One online tree for Daniel Wilson Mitchell gives parents for him and for Emeline, none for Malinda.
