Jan 20 1872 Indenture between Adam P Rhodes and Elias Mason
This Indenture, made the twentieth day of January in the year of our Lord, one thousand, eight hundred and seventy two, between Adam P Rhodes surviving Administrator of all and singular goods and chattels, rights and credits, which were of George Rhodes, late of the township of Hayfield in the county of Crawford and state of Pennsylvania, deceased, of the one part and Elias Mason, of the same township, county and state of the other part: Whereas the said George Rhodes, in his lifetime and at the time of his death, was seized of his land as a fee of all that piece or parcel of land situated in Hayfield Township, Crawford County, Pennsylvania, herein after fully described and set forth and whereas letters of administration of all and singular goods and chattels, rights and credits which were of the said George Rhodes, at the time of his death, were in due form of law committed unto the said A P Rhodes and H J Rhodes. And whereas the said H J Rhodes died on or about the eleventh day of August A D 1871. And whereas the said Administrator at an Orphan's Court held at Meadville in and for the county of Crawford, presented a petition setting forth that the personal estate of the said George Rhodes, deceased, was insufficient to pay his debts, and that it would be necessary to sell the real estate of said decedent for the purpose of paying the same. Whereupon it appearing manifest unto the Court aforesaid, that the personal estate of the said George Rhodes was not sufficient to pay the debts of said decedent it was considered and ordered by the said Court on the thirteenth day of December AD, one thousand eight hundred and seventy one, that the real estate of the said George Rhodes, a full description of which is hereafter given, be sold according to the prayer of the petitioner. And whereas in pursuance of the said order and by force and virtue of the laws of the State are such made and provided afterwards to wit: on the tenth day of January A D 1872, the said real estate to sell at public venue or outcry after giving notice according to the best price bidder therefore, the sale and report thereof made to the Judges of the said Court on the eleventh day of January A D 1872, was confirmed and was considered and adjudged by the said Court that the same should be and remain firm and stable forever; and good and sufficient security approved by the said Court for the faithful appreciation of the proceeds of sale has been duly entered as by the records of the said Court more fully and at large appears. Now this indenture witnesseth that the said Adam P Rhodes, surviving Administrator as aforesaid, for the consideration of the sum of three thousand dollars to him in hand paid by the said Elias Mason at and before the ensealing and delivery hereof, the receipt whereof he does hereby acknowledge, has granted, bargained, sold, aliened, released and continued and by these presents does hereby grant, bargain, sell, alien and release, and confirm unto the said Elias Mason, his heirs and assignees, all the following described piece or parcel of land situated in Hayfield Township, Crawford County Pennsylvania bounded and described as follows to wit: on the east by land of Henry Deiter; on the south by land of John Simms; on the west by lands of Henry Kilmer, Edward Osborne and Elias Mason; on the north by Elias Mason containing fifty-eight acres, more or less, late the estate of George Rhodes deceased. Together also, with all and singular, the ways, waters, watercourses, rights, liberties, privileges, hereditaments and appurtenses whatsoever hereunto belonging or in anywise appertaining and the revisions and remainders, rents, issues, and profits thereof, and also all the right, title, interest, property, claim and demand whatsoever, of the said George Rhodes in his lifetime at and immediately before the time of his decease in law, equity or otherwise howsoever of, in and for out of the same. To have and to hold the said lands, tenements, hereditaments and premises hereby granted or mentioned and intended so to be with the appurtenses unto the said Elias Mason, his heirs and assignees forever. And the said Adam P Rhodes, Administrator has not done, committed or knowingly or willingly suffered to be done, any act, matter or thing whatsoever, whereby the premises aforesaid or any part thereof, is, are or shall or may be changed or incumbered in title, charge, or estate or otherwise howsoever.
