Joseph Wehner Will

Joseph Wehner Deceased April 1st, 1879

The last Will and Testament of Joseph Wehner late of Auglaize County, Ohio, deceased having been on the 1st day of April A.D. 1879 presented for Probate, thereupon said. Will was duly proved by the oaths of George Limbert and John Schaub, subscribing witnesses thereto, who were duly sworn and examined in open court and their testimony reduced to writing and filed by order of the Court and it appearing to the Court from the testimony of said Witnesses that Such Will was duly attested and executed and that the testator at the time of Executing the same was of full age and of sound mind and memory, and not under any restraint it is now here ordered, that said Will be admitted to Probate and filed, and that the same together with the testimony so taken and reduced to writing as aforesaid recorded.

Will

In the name of the Benevolent Father of all, I, Joseph Wehner of Pusheta Township, Auglaize County, Ohio, do make and publish this my last Will and Testament:

Item 1st: I give and devise to my beloved Wife in lieu of Dower one third of all that may be raised on the farm or in other words, one third except my Mother is to have one fourth of about fifteen or sixteen acres until her death, afterwards my Wife shall have the full one third of all of my farm. She shall have all of house furniture.

I do further provide that my just debts are paid, the balance shall be divided among all my children.

I do hereby appoint my Brother Michael Wehner Executor of this my last Will and Testament empowering him to compromise, adjust, release, and discharge in such manner as he may deem proper, the debts, to sell at private sale or in such manner upon such terms of private sale or in such manner upon such terms of credit or otherwise as they may think proper, all or any part of my real estate and deeds to purchaser to execute acknowledge and deliver in fee simple. I do appoint John Gerstner hereby Guardian to my children.

I desire that no appraisement and no sale of my personal property be made, only as above stated, and that the Court of Probate direct the omission of same.

This 27th day of March A.D. 1879

The State of Ohio, Auglaize County. Personally appeared in open Court George Limbert and John Schaub, the Testamentary witnesses to the last Will and Testamentary of Joseph Wehner, late of Pusheta Township, in said Auglaize County, Ohio, deceased, who being duly sworn according to law, to speak the truth, the whole truth, and nothing but the truth, in relation to the Execution of said Will depose and say: That the paper before them, bearing date the 27th day of March A.D. 1879 purporting to be the last Will and Testament of Joseph Wehner, now deceased, is the Will of said deceased, that they were present at the Execution of said Will, and at the request of the testator, respectively subscribed their names to the same as witnesses, in his presence, that they saw the said Joseph Wehner, deceased, sign and seal said Will and heard him acknowledge the same to be his last Will and Testament, and that the said Joseph Wehner at the time of making, signing, and sealing said Will was of lawful age, of sound and disposing mind and memory, and under no undue or unlawful restraint whatsoever.
