      <description>PILOT MOUNTAIN, NC &lt;br&gt;&lt;br&gt;Mr. William “Bill” John Baker, age 92, of 237 W. Dodson Mill Road, Pilot Mountain, NC died Friday evening , August 29, 2008 at Northern Hospital of Surry County. &lt;br&gt;&lt;br&gt;He was born May 16, 1916 in Allegheny County, PA. to the late Charles Edwin &amp;amp; Ida Mae Thomas Baker. &lt;br&gt;&lt;br&gt;Mr. Baker was employed for 35 years with Standard Brands Inc. and held many management positions. He was a member of The American Society of Baker Engineers and served as assistant program chairman. He also served as president of The Allied Trades of The Baking Industry. &lt;br&gt;He was a member of The Masonic Order and received the 50 year pin in Feb. 2000. He was also a 32nd degree mason and a member of Boumi Shrine Temple. &lt;br&gt;He retired in 1979 and moved to Pilot Mountain in 1980. For a number of years he enjoyed woodworking in Will Luebbert’s wood shop. Since coming to Pilot he was involved with the Pilot Mountain Civic Club and received the Citizen of The Year award in 1994. He was also active with Habitat for Humanity and worked on the first five homes they built, also serving on the board of directors. &lt;br&gt;He served on the board of directors for Community Bank and retired from the board as Director Emeritus. He was known for his generosity to the needy and to the local churches. &lt;br&gt;&lt;br&gt;SURVIVORS: &lt;br&gt;&lt;br&gt;DAUGHTER: Jane E. Martin of the Home &lt;br&gt;&lt;br&gt;SON &amp;amp; DAUGHTER-IN-LAW: &lt;br&gt;James E. &amp;amp; wife Nancy Baker; Darien, CT. &lt;br&gt;&lt;br&gt;GRANDCHILDREN: Three &lt;br&gt;GREAT-GRANDCHILDREN: Four &lt;br&gt;&lt;br&gt;SISTERS: Four &lt;br&gt;BROTHERS: Two &lt;br&gt;&lt;br&gt;In addition to his parents Mr. Baker was preceded in death by his wife Mary E. Baker and son David W. Baker. &lt;br&gt;&lt;br&gt;A Memorial Service will be held on Tuesday, September 2, 2008 at 7:00 P.M. at Howell-Nelson Funeral Chapel of Pilot Mountain. In lieu of flowers, memorials may be made to Masonic Village at Elizabethtown, Attn: Office of Gift Planning ( for Masonic Childrens Home) One Masonic Dr., Elizabethtown, PA. 17022. Snow Street, State Road, passed away Wednesday, June 18, 2008 at Hugh Chatham Memorial Hospital. &lt;br&gt;&lt;br&gt;Mrs. Blackburn was born August 30, 1915 in Alleghany County to Clarence &amp;amp; Emma Brown Simmons.&lt;br&gt;&lt;br&gt;Mrs. Blackburn was a homemaker and was the oldest member of Mountain Park United Methodist Church. &lt;br&gt;&lt;br&gt;In addition to her parents, she was preceded in death by William Clonnie Blackburn and a son, Newton J. Blackburn. &lt;br&gt;&lt;br&gt;Survivors include: a son, William D. "Dub" Blackburn and wife Nancy of State Road; a daughter, Iva West of Kernersville; a sister, Stuart Couch and husband Herman of State Road; seven grandchildren, Keith Blackburn, Teresa Bruce, James Crabb, Dwight Crabb, Kenny Blackburn, Kim McFarland and Kurt Blackburn; ten great grandchildren; three great-great grandchildren; a special friend, Shirley Hazeman of Thurmond.&lt;br&gt;&lt;br&gt;Funeral services will be held Friday, June 20, 2008 at 2:00 p.m. at Mountain Park United Methodist Church by Rev. Robert Waddell. Burial will follow at Crestwood Memorial Gardens.       <description>Hi, I am working on the Caudill family tree and I'm trying to sort out some of the relationships.  &lt;br&gt;&lt;br&gt;I found several Ashe/Alleghany deeds that seem to involve the land of William Moxley who died in 1842.  It appears that a number of different people (including Samuel Caudill, Malachi Caudill, and Hugh Caudill) sold their interest in the property to Alfred Moxley.  Now, presumably these were all heirs of William Moxley, but for the life of me I can't figure out how the Caudills are related to the Moxleys.  If anyone can enlighten me, I would greatly appreciate it!&lt;br&gt;&lt;br&gt;The deed in question:&lt;br&gt;&lt;br&gt;Feb. 2, 1851.       <description>I have been trying to research my family tree. My Great Great Grandfather was Colonel Estes Jones, who's father was Millard Filmore Jones, who's father was John A. Jones. John was born around 1814, and married to Elizabeth Baldwin. But that is about all I can find about him. I can't find any real definitive evidence of him or who his father was, so my look back into my family history has kinda hit a wall, Is there anyone who has or can find any more info on him.       <title>Cemeteries in Piney Creek area</title>

      <description>Can anyone tell me names of Cemeteries in the Piney Creek Area.&lt;br&gt;&lt;br&gt;My great grandmother died just before 1900 from TB and was burried somewhere in the Piney Creek area.  I know that my grandfather visited her grave over 50 years ago.. but that is about all I know about it.&lt;br&gt;&lt;br&gt;I want to make a trip to Piney Creek, but am trying to map out where to look first.</description>

      <description>ELKIN - Wilma "Billie" R. Holcomb went to her Heavenly Reward Thursday, April 17, 2008, after an extended illness. &lt;br&gt;&lt;br&gt;Her life on earth was a shining example of what a difference one person can make. &lt;br&gt;&lt;br&gt;Born on Nov. 22, 1921, she grew up in the Laurel Springs community of Alleghany County in the Blue Ridge Mountains, learning life' s lessons from her parents, Robert Avery and Nellie Miller Waddell. &lt;br&gt;&lt;br&gt;Avery was a community leader and well-known cattle farmer and Nellie was a schoolteacher, her first years spent in one-room schoolhouses. After her graduation from high school in 1937, she became a beautician in Sparta, but love and war soon changed things. A "double date" introduced her to her future husband, Jasper "Jack" M. Holcomb of Elkin, and the outbreak of World War II found her uprooted to Washington, D.C., to work as a "de-coder" at "Arlington Hill." While on leave from his Navy Seabee duty, Jack and Billie married on March 1, 1945, this marriage lasting almost 63 years, as Jack passed over on Feb. 15, 2008. Postwar found them back in Elkin to start and raise their family, where they joined the Veterans of Foreign Wars and its Ladies Auxiliary, which would change their lives forever. Billie found herself serving in several offices, chairmanships and even some on the national level, but she is best known for serving as N.C. State Secretary and Treasurer for 41 years straight. Her hard work "for the good of the organization," putting aside any personal gains, was noted by all. She worked hard while striving to keep up with her two growing children who survive her, a daughter, Chloe Ann, and a son, A. Waddell Holcomb. Her other personal accomplishments are too many to mention, but those who knew her were blessed in the knowing. Her body finally wore down from multiple health issues, but her spirit fought on and will live on forever in Heaven with Jack. &lt;br&gt;&lt;br&gt;In addition to her husband, she was preceded in death by her parents; and a brother, Curt Ratledge of Atlanta, Ga. &lt;br&gt;&lt;br&gt;In addition to her children, she is survived by special friends Dorothy T. Hunter and Sylvia W. Crouch and families; as well as a very large Ladies Auxiliary family from William J. Jones Post No. 7794 and across the state. &lt;br&gt;&lt;br&gt;In lieu of flowers, the family requests that memorials be made to a charity of the donor' s choice, or the Erline Mayberry Scholarship Fund. The funeral service will be conducted at 3 p.m. Sunday, April 20, at Johnson Funeral Home Chapel in Elkin, with the Rev. Dr. Bill Johnson officiating. A graveside service will follow at Hollywood Cemetery in Elkin. The family will receive friends at First Baptist Church in Elkin after the graveside service. Johnson Funeral Home of Elkin is in charge of arrangements. Special thanks to the staff and doctors of H.C.M. William enlisted in Company I, 61st North Carolina Regiment, and S.J. and J.W. enlisted in Company F, 22nd North Carolina Regiment. All died in the war. Papers consist of photocopies of the thirty-two letters written among the brothers to each other and to Martha Choate, wife of William.       <description>Isom EDWARDS married Nancy Emiline WILES in 1845, in Surry Co., NC. They left Alleghaney County in 1859 on a wagon train to Arkansas/Missouri. We do have a trail of the family after they arrived in the Arkansas/Missouri area, but have many questions as to prior information.&lt;br&gt;&lt;br&gt;Isom EDWARDS was the son of Stokes EDWARDS and Elizabeth ??.       <description>Bryant was serving alongside his wife Lucy M. Thompson, disguised as Tom Thompson. He was killed during the Seven Days Battles and in accordance with a pact they had, she seturned his body home for burial. Lucy then resumed a normal civilan life. Somewhere I saw that he was buried between Whitehead and Wilmington. Lucy  remarried and had more children and died in Coffee County Georgia in 1925.&lt;br&gt;If anyone can share information on Bryant and/or Lucy I would be very appreciative.       <description>Elkin, NC&lt;br&gt;State Road&lt;br&gt;&lt;br&gt;Mrs. Barbara Jean Cundiff, age 59, of Mount Pleasant Church Road passed away Friday February 22, 2008 at Hugh Chatham Memorial Hospital. &lt;br&gt;&lt;br&gt;Mrs. Cundiff was born November 23, 1948 in Alleghany County to J.B. and Nellie Shaw Andrews. &lt;br&gt;&lt;br&gt;Mrs. Cundiff retired from CFL and was a member of Mt. Carmel Baptist Church. During her early forties Barbara continued her education and graduated from Surry Community College with a degree in accounting. Barbara enjoyed bowling in the mixed league teams at Blue Ridge Lanes in Jonesville. &lt;br&gt;&lt;br&gt;In addition to her father, Mrs. Cundiff was preceded in death by her adopted father, Edwin Ketterling. &lt;br&gt;&lt;br&gt;Survivors include: Three sons; Rodney Waldrop and friend Lisa Wilkins of State Road, Dale Bartley and fiancee' Sarah Crouse of Dobson, Richard Bartley and wife Joanna of State Road.       <description>Mr. William Mack “Bill” Handy, age 81 of Mt. Airy, passed away Sunday, January 27, 2008 at his home. &lt;br&gt;&lt;br&gt;Mr. Handy was born in Alleghany County, May 19, 1926 to Fred and Bertie Wagoner Handy. &lt;br&gt;&lt;br&gt;He was retired from J. G. Coram, Co. Inc. where he was a superintendent. Mr. Handy was also member of Highland Park Baptist Church. &lt;br&gt;&lt;br&gt;Surviving is his wife, Madeline Richardson Handy of the home; two sons and daughters-in-law Gene and Ruth Handy of Mt. Airy and Mike and Gina Handy of Winston Salem, and two grandchildren Chris Handy and his wife Christy of Mt. Airy and Brittany Handy of Winston Salem and three great grandsons William Handy, Austin Handy and Trey Handy all of Mt. Airy. &lt;br&gt;&lt;br&gt;Funeral services will be held Wednesday January 30, 2008 at 2:00 P.M. at the Moody Funeral Home Chapel in Mt. Airy with services conducted by Rev. Edwards of the home; a granddaughter, Robin Edwards Turner, and her husband, Ron, of Elkin; a grandson, Bradley C. He married Mary Louise Pruitt of Alleghany Co. (Mark Waters and his family are listed in the 1880 census as WALTERS.) Mark was the son of William P. Waters and Zilphia. I am trying to detemine the wife-wives of Mark. I think he could have been married twice, once to Fanny Church and also to Linda Parrish (Preston listed Mark Waters and Linda Parrish as his mother and father on his SS application in 1936). &lt;br&gt;&lt;br&gt;Any help would be appreciateed! Also of when Arthur and his wife Ruth were married? And, the burial locations (cemeteries) of James &amp;amp; Thursa (Gambill) McMillan and James &amp;amp; Rosa (Stamper) McMillan. I've been after information of my wife's McMillans and just recently got a lead as to her ancestors, and wanting to get as much info (birth, death and burial locations) as possible.       <description>Mrs. Reva Jeanette Tolliver Boyer, 88, of 322 Taylor Street, Mount Airy, passed away Friday, December 14, 2007, at Northern Hospital of Surry County. &lt;br&gt;&lt;br&gt;Mrs. Boyer was born August 2, 1919, in Alleghany County, to the late Clayton and Della Edwards Tolliver. &lt;br&gt;&lt;br&gt;She was a homemaker and retired from Spencer’s Inc. &lt;br&gt;&lt;br&gt;She is survived by three daughters and a son-in-law, Kathy B. Harris and Joyce B. Phillips, both of Mount Airy, and Janie B. and G. Marshall Collier of Willis, VA; a son, Jimmy R. Boyer of Mount Airy; twelve grandchildren; twenty-seven great-grandchildren; three great-great-grandchildren; a sister and brother-in-law, Emma Lou and France Parisen of Elkton, MD; and several nieces and nephews. &lt;br&gt;&lt;br&gt;In addition to her parents, Mrs. Boyer was preceded in death by her husband, James W. Boyer; two daughters, Frances Jeanette Boyer and Barbara B. Adams; and a son, Clayton M. Boyer. &lt;br&gt;&lt;br&gt;The funeral service will be held Monday, December 17, 2007, at 11:00 AM at Moody Funeral Home in Mount Airy. The service will be conducted by the Rev. Jimmy Slate, and burial will follow at Pleasant Home Church Cemetery in Sparta. The family will receive friends Sunday from 7:00 to 9:00 PM at Moody Funeral Home in Mount Airy.       <description>Mr. Leonard Curtis “Shorty” Spurlin, 75, of 141 Holder Road, Mount Airy, passed away Monday, November 12, 2007, at his home. &lt;br&gt;&lt;br&gt;Mr. Spurlin was born November 18, 1931, in Alleghany County, to the late Leonard Edward and Wretha Jarvis Spurlin. &lt;br&gt;&lt;br&gt;He served our country in the United States Army during the Korean Conflict. “Shorty” was a charter member of the Pine Ridge Volunteer Fire Department, the owner and operator of Spurlin’s Cabinet Shop, and a member of Bible Baptist Church. He was an avid motorcyclist and a talented musician with the Blue Ridge Entertainers, Smoky Valley Boys, and True Gospel Believers. &lt;br&gt;&lt;br&gt;He is survived by three daughters and a son-in-law, Jerry Blue Johnson of Mount Airy, Mary and Miles Collins of Winston-Salem, and Lois Marabillas of Mount Hope, WV; two sons and a daughter-in-law, Terril Lee and Monica Spurlin of Mount Airy and Gene Andrew Spurlin of Bacliff, TX; four grandchildren, Jessica Johnson of Chicago, IL, Shena Spurlin and Haley Spurlin, both of Mount Airy, and Jeffrey Collins of Winston-Salem; his stepmother, Thelma Grace Spurlin of Ennice; a sister, Lynda Spurlin Joyce of Sparta; a brother and sister-in-law, Lonnie David and Rhonda Spurlin of Apex; and special friends, James and Gelene McKnight of Lowgap. &lt;br&gt;&lt;br&gt;In addition to his parents, Mr. Spurlin was preceded in death by his wife, Vera Mae Collins Spurlin; and a brother, Larrie Walter Spurlin. &lt;br&gt;&lt;br&gt;The funeral service will be held Thursday, November 15, 2007, at 11:00 AM at Moody Funeral Home Chapel in Mount Airy.       <description>Toliver descendants may be interested in this tidbit I discovered in the pension application file of Capt. Samuel Johnson of Wilkes County.  It is a declaration filed by John Toliver of Ashe County in support of an application for a widow's pension filed by Capt. Samuel Johnson's widow Mary Johnson. It is pretty interesting and proves that John was the brother of Jesse and Moses Toliver.  Also mentions their mother (not by name).  I've edited this somewhat as it is fairly long.  It is National Archives Pension File No. W.5012.&lt;br&gt;&lt;br&gt;"State of North Carolina, County of Ashe.  On this 20th day of September A.D. 1856 personally appeared [. . .]  John TOLIVER a resident of said county who after being duly sworn according to law states that he has no record of his age but that from the best information he has he thinks he is now ninety one or two years of age -- he states that he lived in the county of Wilkes state of N.C. in the time of the war of the Revolution -- that he was well acquainted in the time of said war with Capt. Samuel JOHNSON of Wilkes County [. . .] that he was well acquainted with the father of said Capt. Samuel JOHNSON in the time of said war -- that he lived in the Yadkin River some four miles below Wilkes boundary that he was an old man in the time of the said war and that his name was Jeffrey JOHNSON -- that he died in said county many years ago -- he further states that he was well acquainted with with one Mary HAMMONS daughter of Ambrose HAMMONS of Wilkes County N.C. in time of said war and that sometime towards the latter part of said war that the said Capt. Samuel JOHNSON and the said Mary HAMMONS got married -- he did not see them married but heard of it at the time -- nor can he fix the precise date of said marriage -- but that he knows that it was before the Battle of Kings Mountain and he knows that it was before he removed with his mother to the west side of the Blue Ridge (now Ashe County) and he further states that after he came to this side of the Blue Ridge to live that the said Capt. Samuel JOHNSON and some of his men was on one or two occasions on this the west side of the Blue Ridge after the Tories -- about the Peach Bottom in the State of Virginia -- that he was with Capt. Martin GAMBILL &amp;amp; others after the Tories [. . .] that it was not far from the section of county where he then lived -- that he was well acquainted with the county and acted as a guide to the parties -- that on one occasion they came for the Tories by discovering their smoke of their campfires -- that they had were cooking their Breakfast -- that they surrendered then fired on them killed some -- and some escaped -- that this was in the state of Virginia now Grayson County -- that on one other occasion they came upon the Tories -- killed some -- that Capt. Martin GAMBILL shot one Tory by the name of GREEN -- that he was left at the house of one John COX who lived at the Peach Bottom and died of the wounds -- that at that time they hung a Tory by the name of MCKINNY that they hung him with a grape vine tied around his neck and fastened to the limb of a tree -- and had him placed on a large rock -- and that while they were considering which of the men should shove him off the rock -- that the said MCKINNY jumped off and hung himself -- and that they hung one [??] a Tory on the gate post of the said John COX near the river in the north side in the state of Virginia -- and many other things too tedious to mention -- he states that he knows positively that Capt. Samuel JOHNSON did service in these expeditions for that he was also in said service that it was near the close of the War of the Revolution [. . .] he states that his two older brothers Jesse TOLIVER &amp;amp; Moses TOLIVER were both with him on these two expeditions -- that they at that time also lived on the west side of the Blue Ridge -- and that they had been in much of said war -- that they were both in the expedition to Kings Mountain and got the foot but did not reach the Battle ground until the Battle had been fought and the victory won -- he states that his two said brothers are now dead . . . ."</description>

      <description>KING - Mr. Everette Eugene Dixon, 79, of 1132 Hillview Drive, King, husband of Mrs. Carrine Avis Secrest Dixon, passed away Wednesday, July 11, 2007, at Forsyth Medical Center in Winston-Salem. &lt;br&gt;&lt;br&gt;Mr. Dixon was born April 22, 1928, in Alleghany County to the late William Genie Dixon and Eva Mae Goodson Dixon. &lt;br&gt;&lt;br&gt;He was retired from Hennis Freight Lines, then was employed by Triad Auto Supply in Kernersville and was also of the Baptist faith. Mr. Dixon was a loving and giving person to all that knew him. &lt;br&gt;&lt;br&gt;Surviving are his wife, Mrs. Carrine Avis Secrest Dixon of the home; two daughters and sons-in-law, Shirley and Steve Hall of King and Diane and Joe Lashmit of Walkertown; three grandchildren and spouse, Anita and Robert Quarles of Houston, Texas, and Scott Lashmit and Kristin Lashmit, both of Walkertown; two great-grandchildren, Justin Kiehl and Amanda Quarles; a sister and brother-in-law, Susie and Roger Inman of Mount Airy; a brother and sister-in-law, Glenn and Mary Dixon of Siloam; and several nieces and nephews. &lt;br&gt;&lt;br&gt;In addition to his parents, Mr. Dixon was preceded in death by a sister, Eva Evans; and six brothers Roy Dixon, Garvie Dixon, Earl Dixon, Verlon Dixon, Robert Dixon and Clyde Dixon. &lt;br&gt;&lt;br&gt;Funeral services will be conducted at 3:30 p.m. Saturday, July 14, at Moody Funeral Home Chapel in Mount Airy, with the Rev.       <description>I know that my gg grandfather, Solomon Wood Young, &amp;amp; his family went from Surry Co. (in 1860 census) to Alleghany Co. (in the 1870 and 1880 census).  Then, by 1900, they are already in Watauga Co.  There are at least 2 of the children that died during those years in Alleghany.  I cannot find ANY info at all about the family during those years... so it's like a big hole in a puzzle.  Does anyone remember seeing anything about the Young's for that time period?  Church/cemetery/taxes, anything?  I would appreciate any little tidbit!!  </description>

      <description>I was wondering if there might be a newspaper in the area of Glade Creek Twp. that would have published an obituary for Elvira(h) Belcher Wright, who died 6 Feb. 1929 per Ancestry's North Carolina Death Collection, 1908-1996.  Her husband, Robert A. Wright, passed away 25 Oct. 1949 in Winston-Salem, but he's buried at Saddle Mountain Union Baptist Church.  My interest is in the Belcher line, but I've been trying to piece together what happened to the eleven Wright children.  Any help with the obituary would be greatly appreciated.</description>

      <description>I am trying to identify a Dickens family from North Carolina.  My great-great grandfather Richmond Bourne Reeves had a son with an unidentified Dickens woman who was named George Pepper Reeves.  George was born 8 May 1895, probably in Grayson Co., VA.  On the 1900 census in Elk Creek, Grayson Co., VA, R.B. Reeves (listed as Richard B.) is living with his son George P., and his "mother in law" Lucinda Dickens.  Lucinda was born Feb 1850 in NC, with father born NC and mother born VA.  She was widowed, and evidently her daughter that had given birth to George Pepper was deceased.  I have no other names from this family other than that of Lucinda.  I would really appreciate any help or leads that anyone could give me.</description>

      <description>I'm looking for the location of a Mabe family cemetery in Alleghany County, NC.  I'm not sure if it is known by another name, but it is the likely burial location of James A. Mabe (25 Feb 1836-6 Feb 1926) a civil war veteran of Alleghany County.  It is also the likely burial location of Alexander Mabe (1794-1870)and his wife Lucinda.&lt;br&gt;&lt;br&gt;Any assistance would be greatly appreciated.</description>

      <description>Just wondering if anyone might have all the Higgins of Alleghany County sorted out.  I actually started with the Wilkes Higgins (where my line originates) but have gotten side tracked with the Alleghany Higgins.  I have the Alleghany Heritage book and have studied each Higgins entry thoroghly.  I see Hazel Higgins Cooper has submitted several.  Is she still available?  I'm finding the online researchers and info available at rootsweb to only confuse me more.       <title>Isaac vs. Isiah Higgins</title>

      <description>I have a mystery  and I am hoping someone on this board can tell me how to solve it.  I have an Isaac C. Higgins (don’t know who his parents are) born  5-18-1831,  Evalina Collins bore him a son the same day he went off to the civil war and then died at Goldsboro.  The son was Martin Alexander Higgins.  Here enters the mystery:  I have an Isiah Higgins, born about 1831 to Hiram Higgins and Mary Willis.  The 1850 census for Alleghany County, North Carolina shows Isiah living with his parents.  No Isaac Higgins listed anywhere in North Carolina that could be him (unless I’m missing something) on the 1850 census.  On the 1860 Census for Alleghany County, NC Isiah is not listed but there is an Isaac listed living alone.  How can I go about finding out if these two men are the same?&lt;br&gt;&lt;br&gt;</description>

      <description>The following court case describes a bizarre incident that occurred in 1843, involving William Toliver, his wife Elizabeth, and their daughters Caroline and Louisa, and Polly Long.&lt;br&gt;&lt;br&gt;*****&lt;br&gt;&lt;br&gt;THE STATE v. WILLIAM TOLEVER, et. al. 27 N.C. 452 (1845)&lt;br&gt;Supreme Court of North Carolina&lt;br&gt;(June Term, 1845.)&lt;br&gt;&lt;br&gt;1. Where the prosecutrix was in the peaceable possession, with her family, of a dwelling-house and its appurtenances, and four persons entered the yard of the house with hostile or unkind feelings and manner, against the will of the prosecutrix, to injure and insult her, and refused to go away when she bade them, and they had a common purpose in so doing, and abetted each other: Held, that such acts and purposes rendered the parties liable to an indictment for a forcible trespass.&lt;br&gt;&lt;br&gt;2. An indictment for forcible trespass will lie at common law if the facts charged amount to more than a bare trespass.&lt;br&gt;&lt;br&gt;3. When the name of the county is mentioned in the margin of the indictment, and it is stated that the dwelling-house on which the forcible trespass is alleged to have been committed was "there situate and being," this must refer to the county mentioned in the margin.&lt;br&gt;&lt;br&gt;APPEAL from ASHE, Spring Term, 1845; Bailey, J.&lt;br&gt;&lt;br&gt;The defendants, WILLIAM TOLEVER and CAROLINE TOLEVER, were tried upon the following indictment, to wit:&lt;br&gt;&lt;br&gt;State of North Carolina,} Superior Court of Law,&lt;br&gt;Ashe County,} ss. Spring Term, 1843.&lt;br&gt;&lt;br&gt;The jurors for the State, upon their oaths, present that WILLIAM TOLEVER, late of the said county, laborer, ELIZABETH TOLIVER, CAROLINE TOLEVER, and LOUISA TOLEVER, all late of said county, spinsters, on 1 April, 1843, with force and arms into a certain yard and dwelling house, then situate and being, and then and there in the possession of POLLY LONG, unlawfully, violently, forcibly, and with a strong hand, did enter into, and then and there unlawfully, violently, forcibly, and with a strong hand did throw certain filth and dead carcasses into the said house, she, the said POLLY, then and there being therein, and then and there did remain cursing, abusing and threatening the said POLLY for a long time, to wit, for one half hour, and other wrongs then and there did, to the great terror of the said POLLY LONG, then and there being, and against the peace and dignity of the State.                       &lt;br&gt;&lt;br&gt;It is unnecessary to detail the testimony introduced on the trial, as the instructions of the presiding judge sufficiently indicate its general nature. The judge instructed the jury that if the defendants, now on trial, together with ELIZABETH, the mother, and LOUISA, the other daughter of WILLIAM, went into the space that had been enclosed as a yard in a peaceful and friendly manner they would not be guilty; but if the four went into the said space with hostile or unkind feelings and manner, against the will of POLLY LONG, to injure or insult her, and there remained against her will and refused to go away when she bid them, and they had a common purpose in so doing and abetted each other, although there was no fence around the said space, yet such acts would constitute a forcible trespass and the defendants would be guilty. The jury found the defendants guilty. A motion was then made in arrest of judgment, for that the offense is not charged to have been in the county of Ashe. This motion was overruled and judgment being rendered pursuant thereto, the defendants appealed. &lt;br&gt;&lt;br&gt;Attorney General for the State.&lt;br&gt;Boyden for defendants.&lt;br&gt;&lt;br&gt;DANIEL, J.  The prosecutrix was quietly in possession of the premises under a parol lease then expired. She was personally present in the house with her family of children when the defendants entered the yard of the house. The judge told the jury that if the two defendants, with ELIZABETH TOLEVER and LOUISA TOLEVER(the two latter of whom were not tried), entered the yard with hostile and unkind feelings and manner, against the will of the prosecutrix, to injure or insult her, and there remained against her will and refused to go away when she bid them, and that they had a common purpose in so doing and abetted each other, such acts would make them guilty of a forcible trespass. An indictment will lie at common law for forcible entry, if it contain such a statement as shows that the facts charged amount to more than a bare trespass; as by violently taking and keeping possession of lands with menaces, force and arms, without the authority of the law, 1 Rus., Crimes, 283. Four persons entered the yard of the nearly defenseless prosecutrix, with a common intent (as the jury have found) to abet each other in injuring and insulting, and actually insulting her with abusive language and gestures, and thrusting from the yard, through her broken door, the carcass of a dead animal. These facts show that it was more than a bare trespass. They had a tendency to alarm some, and cause others to commit breaches of the peace. We think that the charge of the court was correct.&lt;br&gt;&lt;br&gt;Second. The defendants moved in arrest of judgment, because the offense is not, as they say, charged to have been committed in the county of Ashe. The answer is that the county of Ashe is set forth in the margin of the indictment; and the body of the indictment then proceeds to mention the defendants by name "of said county," and that they "into a certain yard and dwelling house, there situate and being, and then and there in possession of POLLY LONG, unlawfully did enter, etc." The words "there situate and being" must refer to the county mentioned in the margin of the indictment.  S. v. Bell, 25 N.C. 506. This motion was properly overruled by the court.&lt;br&gt;&lt;br&gt;PER CURIAM. No error.</description>

      <title>help identify an old picture from Alleghany Co</title>

      <description>I have a picture probably taken sometime between 1880 and 1910 that I can not identify.  It is of a bearded man dressed up in a suit.  It was found with other family pictures suggesting that he might belong to the Billings family or maybe the Williams family, both of which lived in the Stratford area.&lt;br&gt;&lt;br&gt;My gg-grandfather was Samuel Billings (1872-1908).  Could this be his father William Billings (1830-1896)?  &lt;br&gt;&lt;br&gt;Or, another gg-granfather is John Mack Williams (1868-1952).  Could this be his father Colon Williams (1820-1897)?&lt;br&gt;&lt;br&gt;Or, could this be Jesse Atwood (1843-1920)?&lt;br&gt;&lt;br&gt;Maybe someone else has seen this same picture and knows who he is.       <title>Carson death lookup please</title>

      <description>I'm trying to tie my gg grandma, Mary Carson to John and Celia Carson of former Ashe,now Allegh. co.  According to my infor, John Carson died Jan 29, 1852.  He is supposed to be buried at the Andrew and John Carson cem.  When I asked for a lookup in Ashe, where he technically died, they had no record according to a volunteer lookup.  Could someone see if Allegh. co possibly has a record,  John Carson was born 1818 in Ireland.  my gg grandma was Mary Carson b. 1845</description>

They lived in SPARTA, ALLEGHANY CO., N.C.&lt;br&gt;I believe they are all buried at SHILOH UNITED METHODIST CHURCH CEMETERY in SPARTA, N.C.&lt;br&gt;I am also seeking info. on my g-mother,CLARA FLORENCE BARLOW SMITHERS. She was married to ROBERT LEE SMITHERS. At one time they lived in PINEY CREEK and worked for MRS. FIELDS the superintendent of the school in SPARTA,ALLEGHANY CO. N.C.&lt;br&gt;I need info. on her parents and g-parents.I know her mothers name was MARY JANE SHAVER and her father was CHAFIN BARLOW. They were from Bristol,TN. That is where my g-mother was born.       <description>Mrs. Edna Louise Riley Nunn, age 35 of Mt. Airy, wife of Mark Nunn passed away Sunday, February 4, 2007 at her home. &lt;br&gt;&lt;br&gt;Mrs. Nunn was born in Alleghany County, September 1, 1971 to Norman Riley and the late Lucille Hash Riley. &lt;br&gt;&lt;br&gt;She was a loving mother, and was a member of Fellowship Baptist Church. &lt;br&gt;&lt;br&gt;Surviving are her husband, Mark Nunn of the home; a daughter, Ashley Nicole Nunn; a son, John David Nunn both of the home; her father, Norman Riley of Bluefield, WV; sisters and brothers-in-law, Kathy and Gary Keen of Tazewell, VA; Rae and C. T. Conduff of Wytheville, VA; Susie and Billy Hawks of Galax, VA; brothers and sister-in-law, Butch and Vickie Riley of Galax, VA; Charlie Riley of Bluefield, WV; four nieces and five nephews. &lt;br&gt;&lt;br&gt;In addition to her mother, Mrs. Nunn was preceded in death by her maternal grandparents, Blye and Sarah Lou Hash. &lt;br&gt;&lt;br&gt;Funeral services will be held at 11:00 AM, Friday, February 9, 2007 at Oak Grove Baptist Church with services conducted by Rev. Wesley Boyles and Rev. Jack Anderson. Burial will follow in Potato Creek Cemetery in Mouth of Wilson. The family will receive friends Thursday night from 7:00 to 9:00 at Oak Grove Baptist Church 272 Oak Grove Church Rd. Mt. Airy, NC.
