At a Surrogate Court, held in and for the County of Tompkins, at the Office of the Surrogate of the said County, in the City of Ithaca, on the 27th day of February in the year 1899,
Present, Bradford Almy Surrogate.

In the matter of proving the last will and testament of

Eli Woolley
Deceased

An Instrument purporting to be the last will and testament of Eli Woolley bearing the date the 20th day of January in the year 1899 was produced in court and shown to each of the persons sworn as witnesses as herein after mentioned.

Henry D. Wheeler of the town of Genoa in the County of Cayuga being first duly sworn, deposeth and saith that he was acquainted with the above-mentioned Eli Woolley deceased, in his lifetime; that he saw the said Eli Woolley deceased, subscribe, at the end thereof, the instrument now shown to this deponent, purporting to be the last will and Testament of the said Testator and above described; that he heard the said Testator declare the same to be his last Will and Testament that the deponent subscribed his name as a witness thereto in the presence and at the request of the said Testator that the said testator was at the time in the opinion and belief of this deponent, of sound mind and memory, and not under any restraint; and that he was about 79 years of age; that he died on or about the 1st day of February in the year 1899, and was a resident of the town of Lansing in the county of Tompkins at the time of his death,

Said last Will and Testament is in the words and figures following, to wit:

In the name of God Amen

I Eli Woolley of the age of seventy nine years on the Town of Lansing in the County of Tompkins and State of New York, being of sound mind and memory, do make, publish and declare this my last will and Testament in manner following, that is to say:

First I direct that all my just debts and funeral expenses be paid.
Second I give and bequeath to my son E. Emit Woolley all my personal property of every name and nature and whosesoever situated.
III. I give and bequeath to my daughter Flora E. Buck the sum of twelve hundred dollars to be paid by my executor hereinafter named, as following, to-wit: Five hundred dollars to be paid two years from the date of my decease. One hundred dollars to be paid three years from the date of my decease and two hundred dollars to be paid annually thereafter until the full amount of twelve hundred dollars shall have been paid.
IV. I give devise and bequeath to my son E. Emit Woolley all of my Real Estate of every name and nature and whosesoever situated, subject nevertheless to the charge of the payment of the legacy of Twelve Hundred dollars above bequeathed to my daughter Flora. E. Buck.
Lastly, I appoint E. Emit Woolley executor of this my last will and testament, hereby revoking all former wills by me made.

In witness whereof, I have hereunto subscribed my name the twentieth day of January in the year of our Lord, one thousand eight hundred and ninety nine.

We whose names are hereto subscribed, do certify that Eli Woolley the testator subscribed his name to this instrument in our presence and in the presence of each of us, and at the same time, in our presence and hearing, described the same to be his last will and testament, and requested us, and each of us, to sign our names thereto as witnesses to the execution thereof, which we hereby do in the presence of the date of the said Will and write opposite, our names our respective places of residence.
