I, Ebenezer Brooks of Sterling in the County of Worcester & Commonwealth of Massachusetts, believing myself of sound disposing mind; but feeling a decay of bodily health & strength am anxious of making such a disposition of my remaining property (having settled my real estate on my son Ebenezer Brooks Jr for my son and my wife's maintenance) as --- --- most --- to the convenience and peace of my beloved wife and children. I make this my last will and testament revoking all others theretofore by me made.
1st To my daughter Aseneth Burpee, I give and bequeath one hundred dollars and no more.
2nd To my son William Brooks, I give and bequeath one hundred dollars.
3rd. To my son Orin Brooks, I give and bequeath one hundred dollars.
4th To my son Silas Brooks, I give and bequeath one hundred dollars.
5th To my son Forest Brooks, I give and bequeath one hundred dollars.
6th To my son Ebenezer Brooks, I give and bequeath one dollar only, having provided for him otherwise.
7th To my son Schuyler Brooks, I give and bequeath one hundred dollars.
8th and Lastly, I give and bequeath to my beloved wife Tamar Brooks all my household furniture, my chaise, and whatever money there may be in hand at the time of my decease. This request I order to be paid if it should be necessary to reduce the foregoing requests. --- And should there be any thing remaining I order it to be paid equally to my five sons, William, Orin, Silas, Forest, and Schuyler.
I further will and ordain that in case of any of the aforesaid heirs should receive any moneys or other property from me for which they give their notes or obigations, said notes shall go to cancel the provisions of this will except interest on them. --- And if there be any interst due on them at the time of my death the said interest shall be paid to my executor to be distributed according to this will. This my last will and testament is, by me here, be declared, published, signed and sealed the 15th day of January in the year One thousand eight hundred and forty in presnece of us.

Worcester Ma at the court of probate holder at Worcester on the first Tuesday of May AD 1840.

The instrument hereto annexed purporting to the last will and testament of Ebenezer Brooks, late of Sterling in said county, deceased, siezing offered for probate by Ebenezer Brooks and notice have my hand duly given, and no person objecting to the probate there of, and Levi Reed Jr, one of the witnesses, thereto making oath, that he saw said testator sign said will and that the --- John Porter, J.S. Buttwick, and T.A. Blood attneded and --- --- the same as witnesses, in the presence of the testator, who was there of full age, and of sound mind; I name adjudge that said instrument is present and --- that the same he approved and --- as the last will and testament of said deceased.
