Hi,
Thank you very much! Both Alexander and Elizabeth were born approximately 1850. I found that Saline County family too, but they appear to be a different family. The names of the children don't quite match up. I'm pretty sure they are also relatives of mine too somehow, but the connection is missing so far. The FLETCHERs I'm seeking were in Topeka, Shawnee County, KS all along I believe.
Do you have approximate years of birth for Alexander and Elizabeth? Kansas also had censuses for 1885 and 1895 on which they might be found. I looked through the index for both years, but the closest I could find was the one attached. Only one of the childrens' names match up (although it may have been that most had not been born yet, as the census I've attached is the 1885 Saline Co.)

Have you searched Findagrave for Elizabeth? Not knowing her birth year, I couldn't decide if she was listed.

FLETCHER
Hello,
I am new to Kansas research and I know very little about the area. I am Scottish born and living in Canada. A distant relative, living in New Zealand, asked me to see what I could find about our FLETCHERs on the North American side. They have been hard to find so far.
Alexander FLETCHER and Elizabeth FREW married in Scotland (likely Glasgow) in 1880 and it is believed they immigrated to the USA almost immediately. It is believed they went to Kansas and it may even have been Chase County. I wish I had more specific info. to share with you. Six children were born in North America; Elizabeth, Mary, Jean, Agnes, Archibald and Alexander. After Elizabeth (their mother) died, (I don't know when) the father took them back to Scotland. After some time, the father took 5 of the children and immigrated again, this time to New Zealand.
I am looking for any trace of their time in Kansas. I understand that most of the 1890 US census was lost in a fire, which is too bad. Perhaps they appear on the 1880 census, but I doubt it (probably just a bit too early). They may appear on the 1900 census if Elizabeth has not died by then and her family returned to Scotland. Thank you for any clues you might have!
Mary in Canada

The reason I started looking into this is that I found many marriages between first cousin's in my research. Surprisingly, first cousin marriage is legal in 20 states and 5 more under certain conditions, reaching a certain age and/or one of the participants unable to reproduce. One of the states where it is legal is California, which brings to mind a story about a couple of my older cousins. The girl cousin and I lived in California and we had cousins visiting from back east. They fell madly in love, as teenagers do. It was the Romeo and Juliet of our time. Of course even if they had known it was legal, there is no way the parents would have allowed it. Happy ending to the story is that both grew up, married other people, and are living happy lifes. Not sure about the boy cousin, but the girl has been married to the same man for over 40 years.

Kansas Statute 23-2503 reads: "Incestuous marriages void. All marriages between parents and children, including grandparents and grandchildren of any degree, between brothers and sisters of one half as well as whole blood and between uncles and nieces, aunts and nephews, and first cousins, are declared to be incestuous and absolutely void." The statute may be found at
kslegislature.org/li/b2011.../statute/023.../023_025_0003
It appears the law was effective in 1867 after the civil war. Hope this information is helpful.

I'm sorry to hear about your loss. My name is Cheryl Loseman, my grandfather was Otto Keiper from 11 children in Indiana area. An Edwin J Brome was his relative. This Edwin was an accomplished oil painter and I have a couple of his works. I would like the paintings to go back to his family, but don't have much to go on. My grandfather married my grandmother, Margaret Baker, and received these paintings as a wedding present. Is this the same person?

Edith Wood is on the 1905 Kansas census living with the same couple with whom she was found in 1900--L.(ewis) E. and Amie Walters. Amy/Amie Walters died between 1905/1910. Lewis Walters is found as a widower, living as a boarder in the household of Katie Mayer on the 1910, and he subsequently married her, per the 1915+ censuses.

Lewis Edward Walters married Amy Nook Nov. 13, 1888, according to Familysearch, but it did not give a state. Whether that is her maiden name, or from a previous marriage, it did not say.

I see that an Edith Wood married Frederick J. Payne, Jr. in Kansas City, Wyandotte Co., Kansas, on Nov. 4, 1905.

On the 1900 Wyandotte Co. census, there is a L. E. and Amy Walters living in Kansas City, and in the household are Eugenia Wood (born May 1866) and Edith Wood (born March 1887). Eugenia is listed as the sister-in-law of L. E. Walters, and Edith as the niece. It would appear that Eugenia and Edith are mother and daughter. Eugenia states that she was born in Missouri and her parents were born in Pennsylvania. Edith was born in Kansas and her parents born in Indiana and Missouri.

On the 1910 census, Edith H. Payne, age 22, is listed as the widowed daughter in law of Fred J. and Louise Payne, living in their household along with the (mostly adult) children of that couple. This census states she was born in Illinois and her parents born in Illinois and Iowa.

She is not living with the Payne family on the 1915 census.

I think I found a little blurb in the Kansas City Star, dated 2-15-1907, regarding her husband's death: "Frederick J. Payne, jr., a switchman, who was hurt in the Rock Island yards yesterday by falling between two cars, died early this morning at Bethany hospital. He was 28 years old and lived at 220 Mulberry Street, Argentine. He is survived by a widow."

I am looking for the parents of Edith Harriet Wood, DOB 1887 in Kansas. We know she lived with an aunt because she lost both parents young. She married Frederick W. Payne in Kansas in the early 1900s and was widowed quickly (he died in a railroad accident). She says her parents were born in Kansas (dad) and Pennsylvania (mother) in the 1930 US Census. She is said to have family in Illinois and went there after her husband's death for a few years.

Re: Question about the homestead act.

Usually, the initial homestead certificate identified a particular parcel of land that was to be set aside and granted to an individual's family, giving them the right to live there, improve it, farm it, fence it, and so on. The homestead certificate was a promise of future ownership, if the conditions and agreements were fulfilled by the homesteader. The program was not popular among those who owned cattle and similar livestock, and who may have been operating their herds on the property for many years prior to the homestead certificate, because it tended to restrict the grazing ranges.

In order to get the later deed, the one signed by whatever President was in office (or his secretary) that indicated the land was the legal property of the named individual, the individual would have had to physically lived on the property described and made certain improvements, such as building a house, barn, and any other structures necessary to residing there full time for a specified number of years. The multi-year time period was known as time spent "proving up the claim".

I'm not sure why your individual would have paid $700; perhaps it was some detail I wasn't fully aware of in my research, but then, too, this is a later transaction than some of the ones I've seen in my own family research. He may have bought the rights from another homesteader for said sum, or it's possible the requirements for procuring the homestead certificate might have changed somewhat. However, upon doing deeper research, you might find that the rules changed and the payment was necessary to ensure that the individual was serious about living there over the long haul.

My grandmother bought land around 1912 that had been proved up in Oklahoma by a prior homesteader, and his original homestead position required that he spend at least half the year actually residing on the property in some kind of dwelling shelter or structure. I recall stories my dad told about my great-grandfather, the father of the afore-mentioned grandmother, who started purchasing quarter-section parcels (160 acre homesteads) in the county where he settled, tearing down the structures and converting the mostly land from pasture to mostly farming. In many cases, he was the first ever to turn sod and plant wheat on that land, and was nearly always able to pay off the agreed sales price for the land from the proceeds of the first wheat harvest that was sold from that property. There is some truth to the story about people coming in to obtain homestead claims who had no intention of staying; they only obtained the land so they could sell it later on and make a profit.

Homestead rules might have varied from decade to decade. The railroads were initially responsible for starting the trend, because they wanted to get settlers out into the areas where their new planned rail lines would be laid so that produce and livestock shipping fees could help pay for the cost of building the railroad's business. I can't recall whether the land has always been sold from the outset, or if that was a later development. It would be a good idea to do a little more digging to find out what the governing rules were at the time the homestead certificate was granted in terms of what the homesteader would be required to do in order to receive the presidential grant deed. Best of luck in your research. C. Glass

Dennis Sullivan and parents

I was wondering if anyone might have some information to help me out here. My great grandfather was Dennis Sullivan (born 12 April 1900)(died July 1945). He was married to Hazel Jane Ross and had a couple of daughters I believe, one being my grandmother Alice D. who married Vernon Keith Ruggels. Unfortunately not much is known about my great grandfather Dennis. Hazel and he divorced when my grandmother was young. She later remarried to "Mac" McCully.

I have been able to locate a 1910 Federal Census and a 1905 State of Kansas Census. This being where I am stuck. Federal Census shows Dennis's father as Tom L. Sullivan born in Indiana about 1857 or 1858. Mother was Lee A. (unknown maiden name) born in Indiana around 1870. State of Kansas census shows Dennis's father as what appears to be T. J. Sullivan. Mother is the same and all dates are the same. If anyone has any further information about Dennis and/or his parents I would be much appreciated.

His parents seemed to be "Roy" EVANS of Kansas, and Margaret (Maggie) Sorenson of Montana. There is a voter registration for Mrs Carmen E.
I have also been able to find a lot of information for Carmen and Deborah (They are my husbands grandmother and mother). Harold is the conundrum. We haven't been able to confirm that the information is actually the Harold that we are looking for. We think he may have been adopted, which also makes it difficult. I just wanted to know if there were any family members who actually knew for certain. :)

Was this Deborah Harrison 05 Nov 1954 - 08 Aug 2004, wife of Steven Harrison (Forest Lawn Memory Gardens Indiana),
OR
Deborah Tate, 05 Nov 1954 - 05 May 2004.
I see that Carmen has a SSN from California and that Deborah Amm was born in CA (facts like these could help a lot in your questions). There are also many possibilities for Harold EVANS.
RC Nicholson at:
user392423@aol.com

------------------------------------------
looking for information on a Harold C Evans. He may have been adopted, but that information has not been verified. He was married to Carmen Estelle Deses (1915-2007) and had a child, Deboarah Ann Evans (1954-2004). I believe they lived in Kansas, but am not able to verify his name or information. Any hints would be much appreciated.

Question about the homestead act.

I am trying to fill in a few details about my 2nd great grandfather. I found a deed for 160 acres in Kansas which he bought for $700 in 1886. Then I found a homestead certificate granting him the 160 acres and signed by McKinley dated 12 years later in 1898. Why would he have both? And why would he have a homestead certificate for these same 160 acres (the land was described on both certificates, it is the same land) that he already bought 12 years earlier? Could it be that he made a claim under the homestead act so he could dissolve his debt or something? Or...?? Any ideas?

I do realize that the homestead act granted 160 acres, which seems relevant since the original deed was for 160 acres.
Hi Renate,
...Thanks for the help. I will contact the Council Grove library tomorrow and see what I can find out something from the cemetery book as well as the editor of the Republican.
...I agree with you that Elm Creek might not ever have been a town. In the 1900 census, my ancestor was listed as living in Elm Creek which was a 'district' in the town of Wilsey. So Elm Creek may never have been a town or township but just an area near the Creek.
Thanks for you help,
Charlie King

From what I can read, it looks as if someone copied a map from the book "Colorado gold rush: contemporary letters and reports, 1858-1859" by Le Roy Reuben Hafen; James F Willard; Margaret Willard; and Elmer R Burkey.

According to worldcat.org, 366 libraries in the U.S. own this book. Perhaps there's one near you. If not, you can probably request the book through InterLibrary Loan.

See worldcat.org to see which libraries have it.
