To His Excellency Sir George Prevost, Baronet Lieutenant Governor and Commander in Chief in and over His Majesty’s Province of Nova Scotia and its dependencies, etc, etc, etc
The Petition of James Scott & Gardner Wilcox Humbly Therewith
That the one of your Petitioners was born in Ireland and the other in this Province and they both have resided in the County of “Cumberland and” (this is written above with an arrow) Hants for these last Twenty Years, following the farming business, and that they never have received any lands of Government, and are therefore desirous of obtaining Five Hundred Acres each, the quality allowed by his Majesty’s Proclamation they having each a wife and a large family to support, and they would immediately settle and clear the said Land if they can obtain an order of Survey for the same on “the South side of” (written above) of Bass River Mountain County of Hants, in one contiguous tract, they have never taken the Oath of Allegiance Supremacy but are ready and willing when called upon so to do, Your petitioners therefore humbly intrea t(sic) your Excellency would be pleased to take their case into consideration and allow a Warrant of Survey to be made for Said land, and as your petitioners are confident the said land has never been granted or located to any person whatever. And your petitioners as in duty bound with ever Pray.

To The Hon. Ch. Morris You are forthwith, by yourself or Deputy, to admeasure and lay out unto James Scott, four hundred and fifty and to Gardner Wilcox Five hundred acres of Land on the South Side of Bass River Mountain in the County of Hants, for themselves and family (more legal jargon) Given under my Hand at Halifax, this 18 Day of December 1808

3. To the honourable Charles Morris, Surveyor General of Lands
You are forthwith, by yourself or Deputy to admeasure and lay out unto William Reid, Senior four hundred acres, William Reid Junior two hundred fifty, James Reid and George Reid each two hundred, James Smith three hundred & fifty, Joseph Bailey and James Mosher each two hundred acres of lands for themselves and families within the province and make return to the Secretary’s Office, within six months from the date hereof, with Plot or Description hereunto annexed, as also to Certify the Nature and Quality of the said Lands, conformable to His Majesty’s Instructions, and for so doing this shall be your Warrant. Given under my Hand at Halifax, this 28th Day of October, 1812(7? ) J. L Sherbrooke

4. In obedience to the annexed Warrant I do certify that this has been Surveyed and laid out unto James Scott of Hants County Yeoman four hundred and fifty acres of Land and unto William Reid Jun of the same place Yeoman Two hundred and fifty acres of Land which said Tracts of Land are situate lying and being in the said County of Hants on the Area of Land Granted to Joseph Wheelwright and others and an abutted and bounded by the following. Voi unti James Scott the containing 450 acres v unto Wm Reid the lot marked B on the Annexed Plan cont. 250 acres which said Lot, --- A ---B asforesaid --- within the following --- marked A on the annexed Land beginning at the South Western bound of said Wheelwright land from thence to East South five degrees East one hundred and fifteen chains along the line of Daniel McNiels land, thence East sixteen chains, thence South thirty one chains fifty links, thence East eighty chains, thence North thirty one chain fifty links, thence West sixty one chains along the Rear line of Gardner Wilcox land, thence North one hundred and fifteen chains or until it comes to the Rear line of Land Granted to Captain John Steele, thence West forty four chains or until it meets the place of beginning (containing in the whole of the afore described tracts, pieces, parcels of Lots of Land Seven hundred acres according to the annexed Plan. 5. Whereas, application has been made to me, to grant a Certificate, That, certain Tracts or Parcels of Land are not included in the Crown Reservations: which said Tracts of Land are situate, lying and being, in the County of Hants— Containing Seven Hundred Acres the same having been surveyed, and laid out unto — James Scott and William Reid — as by the report of the Surveyor General of Lands, in the Province of Nova Scotia, dated the 8th of this present month with a Plan Annexed, will more fully appear, relation thereunto being had.
I do therefore hereby Certify, that the aforesaid Tracts of Land are not part of, or included in, any District marked out as a Reservation to the Crown.

1. Book 12 page 196
Conveyance: Wm Reid to James Scott registered 16 December 1817 On the oath of James Reid
Know all Men by these Present that I William Reid Junior of Newport in the County of Hants and Province of Nova Scotia Farmer with Sarah my Wife for and in Consideration of the Sum of fourteen pounds Currency of Nova Scotia aforesaid to me in hand paid by James Scott of Newport and County aforesaid Yeoman. The receipt whereof I do hereby Acknowledge and myself thereby Satisfied contested and paid have given granted Bargained Sold Alien conveyed and conferred and by these Present do give grant Bargain sell Alien Convey and confirm unto Him the said James Scott, his Heirs Executors Administrators and --- a Certain Lot of Land situate lying and being in the Township of Newport and County aforesaid and Bounded as the Following (Viz) beginning sixteen chains East of the South West Corner of Land Granted to Him the Said James Scott and beginning thense East Eighty chains thense South thirty one chains and fifty links thence West Eight chains thence (etc no names mentions) containing in all by Estimation two hundred and fifty acres more or less (more legal jargon) signed by William Reid, Sarh Reid, Witnessed by James Reid and Elizabeth Reid and Shurall Dimock Newport 3 June 1817

Conveyance: James Scott to John Gilmore Scott Registered 30 Mar 1821 on the oath of Benjamin Dexter
Know all Men by these Present that I James Scott of the those District & County of Hants and Province of Nova Scotia Yeoman with Catherine my Wife for and in Consideration of the love good will and affection which I have and do bear unto John Gilmore Scott my beloved son, have given granted aliened conveyed and confirmed and by these I do give grant alien and convey and confirm unto him the said John G. Scott and his heirs and assigns one hundred acres of land situate lying and being in the District County and Province aforesaid and bounded as follows Viz the beginning at the Northeast Corner of a lot Granted to William Reid Junior and running thence West thirty two chains fifty links (more chains and links) Furthermore I the Said James Scott with Catherine my wife for myself – my heirs and assigns that I will warrant secure and Defend the above promises unto him the said John G Scott against the lawful claim or demand of any persons whatever In Witness where of I have hereto Set my hand and Seal James Scott Catherine Scott signed sealed and delivered this fourth Day of October 1820 in the presence of John G. Parker, Benjamin Dexter. Personally appeared before me William O’Brien, one of His Majestys Justices of the peace Catherine Scott the wife of the within bounded James Scott and acknowledged that the signed the within deed freely and willingly without any force of Constrait by her husband and thereby conveyed her right of Dowry being examined apart from her said husband and which all I Certify this fourth day of October 1820.

Conveyance: Yarby Scott to John Rolfe et al Registered the 6 July 1827
Know all Men by these Present that I Yarby Scott of Kempt in the County of Hants and Province of Nova Scotia in Consideration of the sum of Twenty pounds of lawful money of the province aforesaid to me in hand well and truly paid by John Rolfe Stephen Rolfe Albert Rolfe William Rolfe and Michael Rolfe before the sealing and delivery of these presents the receipt whereof I of hereby acknowledge and myself to be there with content Have granted bargained sold aliened ---conveyed and confirmed (more legal) certain tract piece or parcel of land situate lying and being in the township of Kempt in the County and Province aforesaid and Bounded and described follows that is to say Bounded in front by the Bason of Minas Southerly by lands of Moses Greeno Northerly by lands occupied by John Burgess and Easterly by lands unknown being that lot now in the possession and occupation of Jonathan Rolfe containing one hundred and fifty acres more or less with the buildings and improvements thereon and the privileges and (more legal) Yarber Scott Signed Sealed and delivered in the presence of H A Emerson Abigail Wier received Windsor 21 July 1826

4. Book 19 page 378 (This is in Windsor on the east side towards Newport. There was a George Scott and sons living in Windsor at the time, not related to James G. Scott and this John may be from his family but I include it because of the Smith connection)
Conveyence: Nat. Will. & Ben Smith to John Scott Registered 16 July 1830 on the oath of Elias T. Dimock

This Indenture made this ---- day of February in the year of our lord one thousand eight hundred and thirty by and between Nathaniel Smith of Windsor, County of Hants and province of Nova Scotia Farmer William Smith and Benjamin Smith Farmers of the said Windsor, County and Province aforesaid and their wives Jane Smith Sarah Smith and Isabel Smith of the one part and John Scott of the other part for the consideration of one hundred and twenty five pounds (legal words) for a certain parcel of land lying and being in the township of Newport, county and Province aforementioned … Viz beginning at a stake near a birch tree which stands at the edge of the marsh on the line between said Smith’s and Lodowick and James Hunter (Chains and links)


5. Book 20 page 244 (this tract is on the Pembroke side of Walton which is towards the Bay from Goshen)
Conveyance: Benjamin Dewolf, Esq to James G. Scott Registered 4 Aug 1831 on the Oath of James Smith
Know all Men by these Present that I Benjamin Dewolf of Windsor in the County of Hants and Province of Nova Scotia in Consideration of the sum of Forty pounds current money of Nova Scotia paid me by James Gilmore Scott of Kempt in the County aforesaid Farmer the (legal blah blah) A certain tract of land situate lying and being upon the Shore of the Bason of Minas abutted and bounded as follows in front where the Bason beginning at the Northeast corner of land formerly Granted to Colonel Tonge’s children thence by the line of said land granted to the Colonel Tonge’s children Two hundred and sixty chains thence East eight chains thence north two hundred and sixty chains to the Bay or Bason thence eight chains to the beginning being a parralel (sic) Lot of Eight chains by two hundred and sixty chains back and bounded on the north east by Lands owned by Thomas C. Haliburton Esquire the line of Surveyor and on the South by lands of the said Benjamin Dewolf Containing Two hundred acres more or less, which lot is a part of a Tract originally granted to Deborah Cotnam by his excellency Sir John Parr Esq by Grant sealed the sixth day of October in the year of our Lord One thousand seven hundred and eighty five and is taken off ---- the Tract – toward Petit rivere. (legal jargon) signed by Benjamin Dewolf in presence of James Smith and Thomas Haliburton 4th day of August 1831

6. Book 21 page 410 (This building lot is in Walton)
Conveyance: Francis Parker, Esq to John Scott Registered Aug 30th 1833 by the oath of Wm. Parker
Know all Men by these Present that We Francis Parker, of Kempt in the County of Hants and Province of Nova Scotia, Esquire and Mary Jennet, wife of the Francis Parker, in Consideration of the sum of Ten pounds lawful money paid us by John Scott of Kempt in the County and Province aforesaid, mariner the (legal blah blah) a certain building lot in the township of Kempt situated on the North side of the road leading from the North Mountain to the Petite River and bounded on Frederick Barto’s West line (more directions) making thirteen square rods or one acres, being lot number five, formerly bargained for by Joseph McLellan from William Parker the second, as the original plan will more fully show.

7. Conveyance: James G. Scott & Wife to Benjamin Dewolf, Equire Registered Jan 9th 1840 on the oath of Francis Parker, Esq. (Walton)
Know all Men by these Presents that We James Gilmore Scott, of Kempt in the County of Hants and Province of Nova Scotia, Farmer and Catherine Scott, wife of said James Gilmore Scott, in consideration of the sum of forty pounds lawful money paid us Benjamin Dewolf of Windsor in the County and Province aforesaid, Esquire, the (blah, blah) A Certain tract of land situate lying and being set on the shore of the Bason of Minas abutted and bounded as follows, in front upon the Bason, beginning at the North East corner of land formerly granted to Colonel Tonge’s Children, thence by the line of said land granted to the Colonel Tonge;s children (for rest see Book 20 page 244 above, it is the same piece of land, they sold it back to Dewolf for the dame money) Witness by Francis Parker, Daniel Parker, and Charles Poulsons, received in Windsor 29th Nov 1837

8. Book 26 page 154 (Located in Goshen)
Conveyance: James G. Scott to James Scott Registered Oct 21 1841 on the oath of Joseph Sentell (?)
Know all Men by these Presents that I James Gilmore Scott, of Kempt in the County of Hants and Province of Nova Scotia, and Catherine my wife, in consideration of the sum of one hundred pounds of good and lawful money paid by James Scott of Town County and Province aforesaid, (blah, blah) Viz beginning at the South West corner of land originally granted to Joseph Wheelwright, thence (chains and links) containing two hundred and twenty two acres more or less. Also one hundred and fifty acres off the west and ot the lot I purchased of William Reid. As also (blah) a certain lot of interval land bounded as follows viz Eastwardly and Southwardly by lands of William Mitchell, Westerly by Samuel Kirkpatrick’s land and Northerly by James Edwards land containing by estimation fifty acres more or less. Witness by William Salter and William Knox Nov 11, 1839

9. Book 27 page 427 (This was a mortgage that Smith paid off in a little over a year, the land is in Goshen. It included buildings and rental units)
Conveyance: James Scott to Benjamin Smith Registered April 1 1844 on the oath of William Saunders
This Indenture made this 18th day of February in the year of our Lord one thousand eight hundred and forty three Between James Scott of Kempt, county of Hants and province of Nova Scotia and Mary, his wife, on the one Part, and Benjamin Smith of Newport, county and province aforesaid, farmer, of the other part … in consideration of the sum of Ninelty one pounds, ten shillings, … A certain lot of land in Kempt and bounded as follows, Westerly by lands owned by John Scott and Henry Sanford, and Northerly by Land owned by Thomas Rolfe, containing in all Three Hundred and seventy five acres, more or less, likewise the Wild Meadow Land, hereon to belonging, bounded Northerly on land owned by James Edwards, Southerly by land owned by William Mitchell, which said Tract of land was conveyed to the said James Scott by Deed from his father. To have and to hold the said lot of land, buildings and premises with the tenements… Witnessed by Dickson Lockhart and Robert Stevens declared 21 April 1843.

10. Release: Felix Cochran to James Scott registered May 23 1844 (release of mortgage)
(see book 26 folio 311 for details, I am not sure where this is and need to get this detail)
Indenture bearing date the ninth day of March in the year of our Lord one thousand eight hundred and forty-two and registered in Liber 26 folio 311, in the registry of deeds in Windsor, James Scott of Kempt, in the said county of Hants and Province of Nova Scotia did mortgage certain lands and premises therein fully described, to Felix Cochran of Newport for securing to him the payment of the sum of twenty five pounds, with lawful interest therein. Now I the said Felix Cochran di hereby certify that the said mortgage is fully paid off and satisfied….. Witnessed by Edward A. Church and Robert Smith

Conveyance: William Henry Sanford & Wife to James Scott registered Sept 25 1849 at 9 o’clock am on the certificate of William Sanders J.P.
This Indenture made this thirty first day of March in the year of our Lord One Thousand eight Hundred and forty six, Between William Henry Sanford of Kempt in the County of Hants and Province of Nova Scotia, mariner, and Ruth M. Sanford his wife, of the one part, and James Scott of Kempt in the County and Province aforesaid, Mariner, of the other part Witnesseth, that the said William Henry Sanford and Ruth M. Sanford his wife for and in consideration of the sum of Forty three Pounds of good and lawful Money of Nova Scotia to them in had well and truly paid by the said James Scott …. A certain parcel of land being at Walton in Kempt aforesaid on the south side of the Petite River, beginning at a certain Stake place or to be placed on the North side of the road leading to LeCheverie, thence running (blah, blah) containing by computation six acres be the same more or less

This Indenture made this fifteenth day of April in the year of our Lord One Thousand eight hundred and forty seven between James Scott of Kempt in the county of Hants and Province of Nova Scotia, Yeoman, and Mary Scott his wife, of the one part and Daniel Mckenzie of Kempt aforesaid in the county and Province aforesaid, Mariner, of the other part, … in consideration of the Sum of Sixteen Pounds … a certain piece or parcel of Land lying and being in Walton in Kempt aforesaid being part of a Lot or parcel of Land purchased by the said James Scott of one Henry Sanford of Walton …Containing Two acres be the same more of sell together with all outbuildings thereon, ways, waters, water courses hereditaments and appurtenaces (?) to the said Lot …Witnessed by George Harvey and William Sanders

This Indenture made this twenty fourth day of January in the year of our Lord One Thousand eight hundred and forty eight between James Scott of Kempt in the county of Hants and Province of Nova Scotia, farmer, and Mary Scott his wife, of the one part and Archibald McKenzie of Kempt aforesaid in the county and Province aforesaid, Mariner, of the other part,… … in consideration of the sum of eight pounds …a certain piece or parcel of Land lying and being in the village of Walton on the south side of the Petite River in Kempt aforesaid being part of a Lot or parcel of Land deeded by one Henry Sanford to the said James Scott … containing by computation one acre be the same more or less. Together with all buildings, ways waters watercourses hereditaments and appurtenaces.

Conveyance: James Scott & wife to Nelson Sanford registered May 1st A.D. 1855 at 10 o’clock a.m. on the certificate of John L. Brennan J.P.
This Indenture made this twenty eighth day of May in the year of our Lord One Thousand eight hundred and fifty four between James Scott of Walton in the county of Hants and Province of Nova Scotia, farmer, and Mary Scott his wife, of the one part and Nelson Sanford of Walton aforesaid, Mariner, of the other part, …in consideration of the sum of one pound and ten shillings … Beginning at a stake set on the road leading from Walton to Cheverie, thence running North Sixth two degrees West two chains six and one half links to a stake, thence south twenty degrees East one chain (more chains) containing 40 square rods more or less.
