Hi there,
I have a question regarding custody in 1946. Can anyone assist?
In 1944 my grandparents were married. This union produced a child the same year (1946) in which my grandparents were divorced. At the time, the divorce stated that custody was granted to my grandmother. In 1964 my grandmother petitioned the court to change my fathers name. The legal notice claims she had SOLE custody. The final name change decree states she was the SOLE guardian.
It has been my experience in earlier records in other states, that custody is not typically listed as SOLE custody, unless a petition is filed. Typically the plea (either guardianship requests, or name change requests) states that anyone has the right to protest. When Sole custodian, or guardian is listed on the legal notice, it provides just cause . I do not know if Illinois had different laws during that time frame.
Rather than nose dive into a fruitless search for additional records regarding the custody issue I hope someone might be able to tell me particulars about custody laws in 1946-1965.
1. Was it required to obtain sole custodianship after a divorce between 1946-1965
2. What were the laws regarding a legal name change during 1964/65
3. Would the other parent have to be notified if the name was going to be changed if there was Sole Guardianship
etc.
